    CUSTOMS (AGREEMENT ON COMPREHENSIVE ECONOMIC PARTNERSHIP AMONG MEMBER STATES OF THE ASSOCIATION OF

    SOUTHEAST ASIAN NATIONS AND JAPAN) ORDER, 2008

    In exercise of the power conferred by section 9(1) of the Customs Order, 2006, the Minister of Finance, with the approval of His Majesty the Sultan and Yang Di-Pertuan, hereby makes the following Order —

    Citation and commencement.

    1. This Order may be cited as the Customs (Agreement on Comprehensive Economic Partnership Among Member States of the Association of Southeast Asian Nations and Japan) Order, 2008 and shall commence on 1st. January, 2009.

    Rates of customs duties.

    2. There shall be levied in respect of the imported goods specified in the Schedule which are shown to the satisfaction of the Controller to have originated from and to have been consigned direct from either Japan or from a member state of the Association of Southeast Asian Nations customs duties at the rates and in respect of the years specified in the Schedule or customs duties at the rates specified in the Customs Import Duties Order, 2007 (S 45/07), whichever is the lower.

    Deemed country of origin of goods.

    3. For the purposes of paragraph 2, goods shall be deemed to have originated from and to have been consigned direct from either Japan or from a member state of the Association of Southeast Asian Nations where they conform to the Rules of Origin under Chapter 3 of the Agreement on Comprehensive Economic Partnership Among Member States of the Association of Southeast Asian Nations and Japan.
