Ini adalah rujukan di bawah seksyen 20(3) Akta Perhubungan
Perusahaan 1967 mengenai pembuangan kerja ENCIK MUHAMAD
AMIR AMRAN BIN JAMALUDIN (“Pihak Menuntut Yang Pertama”)
DAN ENCIK NOOR ZAKUAN BIN GHAZALI (“Pihak Menuntut Yang
Kedua”) oleh F & NCC BEVERAGES SDN. BHD. (“Pihak Syarikat”).
AWARD
Kes ini merupakan rujukan oleh Y.B. Menteri di bawah kuasa
Seksyen 20 Akta Perhubungan Perusahaan, 1967 berhubung
pembuangan kerja Muhamad Amir Amran bin Jamaludin (selepas
ini dirujuk sebagai “Yang Menuntut Pertama”) dan Encik Noor
Zakuan Bin Ghazali (selepas ini dirujuk sebagai “Yang Menuntut
Kedua”) (kedua-dua Yang Menuntut dirujuk sebagai “Yang Menuntut”)
oleh F & NCC Beverages Sdn. Bhd. (dirujuk sebagai “Syarikat”) pada
18 Disember 2003.
Fakta Kes
Yang Menuntut Pertama telah mula bekerja dengan pihak
Syarikat mulai 1 November 1997 sebagai Assistant Production
Supervisor. Pada 1 Oktober 1999 beliau telah dinaikkan pangkat ke
jawatan Supervisor Production dengan gaji bulanan sebanyak
RM1,951.00. Semasa beliau dibuang kerja, gaji bulanan beliau adalah
sebanyak RM2,640.00.

Yang Menuntut Kedua telah mula bekerja dengan Syarikat pada
10 November 1997 sebagai Assistant Quality Control Supervisor. Pada
1 Disember 1999 beliau telah disahkan jawatan sebagai Quality
Control Supervisor. Gaji terakhir beliau sebelum dibuang kerja adalah
sebanyak RM2,264.00 sebulan.
Melalui surat yang bertarikh 4 November 2003, pihak Syarikat
telah mengeluarkan satu notis Perbicaraan Dalaman dengan satu
tuduhan terhadap kedua-dua Yang Menuntut seperti berikut:
(b) Terhadap Yang Menuntut Pertama
Tuduhan
“Bahawa anda pada 9 Oktober 2003 ditugaskan untuk
menjalankan penyeliaan bahagian Pengeluaran Line 5 untuk
syif yang dijalankan antara pukul 10 malam sehingga 7
pagi. Adalah didapati bahawa anda tidak menjalankan
tugas tersebut dengan sempurna yang telah
mengakibatkan kesemua hasil keluaran Line 5 antara lebih
kurang pukul 3.10 pagi sehingga 7.00 pagi tidak menepati
kualiti yang diperlukan dan hasil daripada itu sebanyak
51,500 tin keluaran line tersebut terpaksa dimusnahkan.
Perkara tersebut telah mengakibatkan kerugian yang
dianggarkan sebanyak RM44,310.77. Anda juga tidak
melapurkan di dalam “Daily Production Report” pada hari
tersebut bahawa ada masalah seperti yang terjadi pada hari
tersebut”.
Ini dianggap sebagai satu tindakan salah-laku yang serius
oleh pihak Syarikat.

(b) Terhadap Yang Menuntut Kedua
“Bahawa anda pada 9 Oktober 2003 ditugaskan untuk
membuat penyeliaan Quality Control yang syif yang
dijalankan antara pukul 10 malam sehingga 7 pagi. Adalah
didapati bahawa anda tidak menjalankan tugas tersebut
dengan sempurna yang telah mengakibatkan kesemua hasil
keluaran Line 5 antara lebih kurang pukul 3.10 pagi
sehingga 7.00 pagi tidak menepati kualiti yang diperlukan
dan hasil daripada itu sebanyak 51,500 tin keluaran line
tersebut terpaksa dimusnahkan. Perkara tersebut telah
mengakibatkan kerugian yang dianggarkan sebanyak
RM44,310.77. Anda juga merakamkan bahawa QC
Inspector pada hari itu telah menjalankan tugasnya untuk
memeriksa keluaran tersebut tetapi tidak melapurkan
tentang hal yang demikian.”
Ini dianggap sebagai satu tindakan salah-laku yang serius
oleh pihak Syarikat.
Kedua-dua Yang Menuntut juga telah digantung kerja dari
7 November 2003 sehingga 20 November 2003 dengan bayaran
separuh gaji dan dari 21 November 2003 sehingga 27 November 2003
dengan bayaran gaji penuh. Seterusnya penggantungan tersebut
dilanjutkan dari 28 November 2003 ke 11 Disember 2003.
Siasatan Dalaman tersebut telah diadakan pada
2 Disember 2003. Kedua-dua Yang Menuntut telah diwakili oleh
pihak Kesatuan Sekerja mereka. Setelah mendengar saksi-saksi dan
meneliti dokumen-dokumen yang dikemukakan, Panel Siasatan
Dalaman telah mendapati kedua-dua Yang Menuntut adalah bersalah
terhadap tuduhan yang dikemukakan terhadap mereka.
Melalui surat bertarikh 18 Disember 2003, pihak Syarikat telah
mengambil keputusan untuk menamatkan perkhidmatan mereka
dengan serta merta.4
Rayuan kedua-dua Yang Menuntut juga telah ditolak oleh pihak
Syarikat pada 29 Januari 2004.
Kedua-dua Yang Menuntut mendakwa penamatan perkhidmatan
mereka oleh pihak Syarikat adalah tidak adil dan tidak beralasan.
Peruntukan Undang-Undang
Fungsi Mahkamah Perusahaan di dalam sesuatu kes
pembuangan kerja telah dijelaskan oleh Azlan Shah CJ (Malaya) dalam
kes Goon Kwee Phoy v J&P Coat (M) Bhd. [1981] 1 LNS 30;
“Where representations are made and are referred to the
Industrial Court for enquiry, it is the duty of that Court to
determine whether the termination or dismissal is with or
without just cause or excuse. If the employer chooses to
give a reason for the action taken by him the duty of the
Industrial Court will be to enquire whether that excuse or
reason has or has not been made out. If it finds as a fact
that it has not been proved, then the inevitable conclusion
must be that the termination or dismissal was without just
cause or excuse.”
Pihak Syarikat perlu membuktikan bahawa Yang Menuntut telah
melakukan salahlaku tersebut dengan mengemukakan keterangan-
keterangan yang kukuh dan meyakinkan (cogent and convincing).
Prinsip ini telah disebut dengan jelas di dalam kes Stamford
Executive Centre v Dharsini Ganesan [1986] 1 ILR 101;
“It may further be emphasised here that in a dismissal
case the employer must produce convincing evidence that
the workman committed the offence or offences the
workman is alleged to have committed for which he has
been dismissed. The burden of proof lies on the employer.

He must prove the workman guilty and it is not the
workman who must prove himself not guilty. This is
so basic a principle of industrial jurisprudence that no
employer is expected to come to this Court in ignorance of
it.
Pada masa yang sama, Mahkamah mengambil maklum bahawa
tahap pembuktian yang perlu dilakukan oleh pihak Syarikat adalah
pada tahap imbangan kebarangkalian sahaja (Telekom Malaysia
Kawasan Utara v Krishnan Kutty a/l Sanguni Nair & Anor [2002]
3 CLJ 314.
Penilaian Dan Dapatan
Tuduhan-Tuduhan Terhadap Kedua-dua Yang Menuntut
Peguam kedua-dua Yang Menuntut telah berhujah bahawa
tuduhan yang dikemukakan oleh pihak Syarikat terhadap kedua-dua
Yang Menuntut adalah cacat/defektif. Ini adalah kerana tuduhan
tersebut telah gagal untuk memberikan fakta-fakta material iaitu
bagaimana kedua-dua Yang Menuntut telah “tidak menjalankan tugas
tersebut dengan sempurna”. Tuduhan tersebut tidak mengatakan
apakah tugas-tugas Yang Menuntut yang telah gagal dilaksanakan
dengan sempurna menyebabkan Yang Menuntut dibuang kerja.
Di dalam kes Esso Production (M) Inc. v Maimunah Bte
Ahmad [2002] 2 MLJ 458, Mahkamah Rayuan telah memutuskan
bahawa kesahihan (validity) sesuatu tuduhan adalah “threshold of the
matter” sebelum merit sesuatu kes dapat dipertimbangkan.
Mahkamah Rayuan mengatakan;
“.... They are material particulars required to be disclosed in the
charges. Without that, how would one accused upon the
charges be able to prepare proper defences to them.....”

“The validity or otherwise of the charges is the threshold of the
matter before the merits could be considered. Looking at the
two charges as they stood, we would not hesitate to say that
they are bad and the learned judge was therefore, correct when
he said that such charge for want of the material particulars is
void ab initio”.
Di dalam kes Dorsett Regency (M) Sdn. Bhd. v Azham Shah
Mohamad Yusof & Satu lagi [2006] 5 CLJ 82, Raus Sharif J
mengatakan;
“.....Jelas pertuduhan yang dikenakan terhadap responden
pertama tidak mendedahkan perkara material bagi
membolehkan responden pertama menyediakan pembelaan
yang sempurna. Ini dengan sendirinya membuatkan keputusan
inkuiri terhadap responden pertama sebagai yang berasaskan
kepada pertuduhan-pertuduhan yang tidak sempurna tidak
boleh dipertahankan...”
Di dalam kes Intrakota Consolidated Bhd v Mohamad Roslin
Md Shah (2008) 8 CLJ 81 Lau Bee Lan J telah memutuskan bahawa ;
“What is of particular importance is the validity of the charge
preferred against the 1st and therefore material particulars as to
time, place and identity of persons referred to in the charge are
essential to enable the 1st respondent to know with certainty the
charge levelled against him and to allow him to prepare and
conduct his defence; as the learned Chairman stated p.8 of the
impugned award, “It may well be that it is also within the
personal knowledge of the Claimant (1st respondent), but it is
not for the Claimant to fill in the gaps.... it is for the Company to
lay all the bare fact as the burden is always upon the Company
to show by evidence that the excuse or reasons given to
terminate the Claimant's employment has been made out or
proven”.

Oleh itu memandangkan pertuduhan yang dihadapi oleh Yang
Menuntut tidak mendedahkan perkara material iaitu apakah tugas-
tugas Yang Menuntut yang gagal mereka laksanakan dengan
sempurna telah menyebabkan tuduhan tersebut adalah defektif dan
oleh itu tuduhan tersebut ipso facto terbatal (void ab initio). Oleh itu
Mahkamah ini tidak perlu meneliti merit kes tersebut. Walaupun
begitu, Mahkamah ini berpendapat adalah lebih baik sekiranya
Mahkamah meneliti merit kes ini dan memberikan keputusan
berdasarkan merit kes memandangkan saksi kedua-dua pihak telah
memberikan keterangan dan juga merujuk dokumen-dokumen untuk
membuktikan kes masing-masing.
Pertimbangan Merit Kes
Kedua-dua Yang Menuntut telah bekerja dalam syif yang sama
pada malam tersebut iaitu dari 10 malam pada 9 Oktober 2003
sehingga 7 pagi pada 10 Oktober 2003.
Yang Menuntut Pertama adalah “Production Supervisor” yang
tugas utamanya adalah untuk mengawas (supervise) production dalam
line-line tertentu manakala Yang Menuntut Kedua adalah “Quality
Control Supervisor” yang bertanggungjawab untuk menentukan
“quality control” untuk setiap produk yang dikeluarkan oleh line-line
tersebut.
Aliran Proses Kerja untuk penyediaan minuman tin ini yang
dikemukakan oleh saksi pihak Syarikat adalah seperti berikut;
Proses Pertama: Depalletiser - membekalkan can kosong untuk filler.
Proses kedua: Filler - akan memasukkan sirap ke dalam can kosong yang disediakan.
Proses ketiga: Nitrogen doser
- akan memasukkan nitrogen ke dalam can yang sedia ada sirap di dalamnya.

Proses keempat: Seamer - can akan dicantumkan (seaming) dengan lids.
Proses kelima: ADR 1 - mengesan dan menolak can yang lembik (kurang atau tiada nitrogen).
Proses keenam: Retort - can akan di “retort”.
Proses ketujuh: Filtec - can yang underfill ataupun overfill akan ditolak di sini.
Proses kelapan: ADR II - can yang mempunyai nitrogen yang kurang akan ditolak di sini.
Proses kesembilan:
Packer - can akan dibungkus di sini.
COW-1 telah menjelaskan proses ini seperti berikut;
CO-1: Process begins when the empty cans are sent from the
Depalletiser to the filler. At the filler, the syrup will be filled in
into the empty cans. Nitrogen will be filled into the cans which
already have syrup in it. The can will be sealed during the sealing
process to join the lids.
At ADR 1 it will detect and reject the soft cans which have
less or low nitrogen in it.
Then the can will be undergo a process called retorting.
After retorting, the can will undergo a filtec process. Under
filled cans or overfilled cans will be rejected here.
After that the cans will go through ADR 2. Cans which
have low or less nitrogen will be rejected in this process.
The last process is packing where all cans will be packed.
Seterusnya COW-1 mengatakan;
I will explain the retort process: retort machines are divided into
3 processes;
1) First is the heat-up process.
2) Next is the process pasteuriser.
3) Then the cooling process.

The whole process normally takes about 1 hour and
15 minutes.
Each retort has 6 baskets. To fill up 6 baskets it
takes about an hour.
For line 5, we have 2 retort machines.
The cans which were put into the baskets in the retort
machines have been filled up with syrup and nitrogen and the lids
are sealed.
COW-2, Chong Fook Seng, “Shift Manager” untuk shif pertama
iaitu dari pukul 7 pagi sehingga 2.30 petang pada bulan Oktober 2003
mengatakan di dalam Penyata Saksi beliau seperti berikut;
Q : Refer to pages 14 and 15 of the Company's Additional
Bundle of Documents. Please explain the nature of this
document.
A : This is a report dated 13 October 2003 which I prepared
as record of investigation into the incident of wastage of
wintermelon drinks produced from Line 5.
Based on this report which I prepared, I was informed by
Jazaruddin during the 1st shift of 10 October 2003 at
around 9:15 am that the products at Line 5 which came
out from Retort 12 were all rejected by the Automatic
DUD Rejector II (ADR II) as the can produced were soft.
Inspection by the Quality Control Inspector revealed that
there was low nitrogen pressure during filling process
during 3rd shift.
The low nitrogen pressure in the cans could be detected,
had the Quality Control Supervisor, Noor Zakuan ensure
that the Quality Control Inspector conduct the necessary
checks. The Production Supervisor, Muhamad Amir was
expected to take immediate and appropriate actions at
the time the defect ought to have been discovered.
However, this was not done as we only discovered the
defect the next day during my shift which was the 1st
shift.

We found that a total of 51,500 cans of drinks were
rejected due to low nitrogen pressure over 7½ hours
worth of production. We then informed the Deputy
Operations Manager of the incident with regards to the
wastage.
Q : What happened after that?
A : We then checked the daily production report signed off by
the 1st Claimant and the Quality Control report signed off
by the 2nd Claimant for the 3rd shift of 9 October 2003 and
found that the report was inconsistent with the incident.
The Claimants failed to report the low nitrogen pressure
which occurred on or about 3:10 am of 9 October 2003
i.e. during their shift. As Shift Manager, we expect the
Production Supervisor and Quality Control Supervisor to
ensure that the production lines are managed properly.
The incident on 9 October 2003 would not occur had the
Claimants performed their task in a proper manner.
Both the Claimants failure to ensure that the production
line was stopped as soon as the low nitrogen pressure
occurred had caused loss suffered by the Company. This
is a serious offence.
Hujahan pihak Syarikat adalah bahawa kedua-dua Yang
Menuntut telah cuai menjalankan tugas-tugas mereka semasa syif
mereka untuk memeriksa kandungan nitrogen yang berada dalam
paras yang rendah menyebabkan tin-tin menjadi lembik pada
peringkat ADR II dan sebanyak 51,500 tin terpaksa dimusnahkan.
COW-1, Tan Bee Chin, Assistant Manager untuk “Quality Control”
di dalam Syarikat menjelaskan tugas-tugas serta tanggungjawab
kedua-dua Yang Menuntut seperti berikut;
Q : Apart from filling this form, what other roles and
responsibilities do the QCI and QCS have, in particular with
regards to monitoring of tins produced?

A : As I have stated earlier, both the QCI and QCS will generally
need to check that the goods produced are up to the
Company's standards. This includes having to check that the
nitrogen content in tins produced is sufficient by using the
nitrogen tester.
Q : Are there any physical checks they have to carry out on the
products?
A : Yes. The testing by using the nitrogen tester is in fact a
physical test. They will need to take a sample from the line
and test it using the nitrogen tester.
Q : How could the QCI and QCS detect “soft cans”?
A : Firstly, soft cans can be detected by visual observation. Soft
cans will show some form of distortion and the cans will not
be smooth as they ought to be. Secondly, it will be a matter
of taking a sample every hour and using the nitrogen tester
on it.
Seterusnya COW-1 memberi keterangan berkaitan kecuaian
kedua-dua Yang Menuntut seperti berikut;
Q : On the face of the QC report appearing in pages 5 - 7 in
COB-2, does it capture any problems with the production?
A : Yes. Towards the end of the 3rd shift, it can be seen that
problems were detected and apparently documented.
Q : Who signed this QC report on page 7 of COB-2?
A : The QC report was signed by the QCI, one Fauzi and the 2nd
Claimant as the QCS.
Q : Looking at page 5 of COB-2, are the nitrogen levels recorded
at an acceptable level?
A : At 0535 hours, the nitrogen level had dipped to 0.70 which
the Company considered unacceptable.

Q : Why do say it's unacceptable when the form states that a
reading of 0.60 is within acceptable range?
A : Although the form says the reading of 0.60 is acceptable, it
was a Company practice that the nitrogen level should not
read below 0.9 for our cans. All employees including the QCI
and the Claimant were well aware of this as we had meetings
where all QC staff were briefed on this requirement.
Additionally, if you look at the right hand corner at the bottom
of page 5, the QCI had in fact highlighted that he informed PS
Amir about the nitrogen level reading which was 0.80. This
shows that he was aware that a reading below 0.90 was a
cause for concern.
Q : Why is it that the Company has contended that the Claimants
failed in their duties and responsibilities?
A : The entire production for that shift had to be rejected. All the
cans produced in that shift were defective even before any
low nitrogen reading was recorded. This shows that the
records that were wrong and the report does not tally with
the actual situation. Furthermore, had the QCI and QCS done
their jobs, the defects in the cans would have been detected
earlier and substantial wastage could have been avoided.
Yang Menuntut Pertama di dalam Penyataan Saksi mengatakan
seperti berikut;
Q : Sila beritahu Mahkamah apa yang berlaku pada syif malam
9.10.2003?
A : Pada malam tersebut saya bekerja dari pukul 7 malam hingga
10 malam line 2. Kemudian saya mengambilalih sebagai
Penyelia line 5 pada pukul 10 malam hingga 7 pagi esok.
Pada masa itu tiada masalah tentang nitrogen di bawah
spesifikasi dilaporkan. Cuma pada pukul 6.40 pagi saya
diberitahu oleh QCI Encik Fauzi tentang kandungan nitrogen
pada 0.89 tetapi masih di dalam spesifikasi.
Q : Apakah tindakan awak pada masa itu?

A : Saya berbincang dengan QC Inspektor Fauzi dan merujuk
kepada laporan yang dibuat oleh beliau dan mendapati
tekanan nitrogen yang dicatit sebelum itu berada dalam tahap
spesifikasi yang diterima iaitu 0.6 – 1.4.
Saya menghubungi Engineering Supervisor, En. Zabidi untuk
memberitahu dia bahawa terdapatnya 'trend' penurunan
tekanan nitrogen. Saya juga memberitahu kepada Encik
Jazaruddin yang mengambilalih tugas syif saya.
Q : Kalau ada kegagalan dari segi kekurangan dosing nitrogen
bolehkah QCI En. Fauzi mengenalinya semasa bertugas di line
produksi?
A : Ini bergantung kepada sample yang diambil olehnya.
Q : Adakah anda memeriksa laporan yang dibuat oleh QCI Encik
Fauzi berhubung QC sampling?
A : Laporan QCI Fauzi untuk syif tersebut menunjukkan bahawa
ianya di dalam tahap spesifikasi yang dibenarkan.
Q : Adakah anda menerima apa-apa laporan atau informasi
tentang masalah 'soft can' di bawah tahap spesifikasi?
A : Pada masa syif tersebut tidak.
Q : Bilakah anda dapat tahu tentang masalah 'soft can' tersebut?
A : Saya hanya dapat tahu tentang isu 'soft can' tersebut apabila
saya melaporkan diri untuk syif pada pukul 7 malam pada
10.10.2003.
Q : Adakah anda menandatangani Daily Production report untuk
syif 10 malam hingga 7 pagi bertarikh 9.10.2003?
A : Ya, saya menandatangani report itu dan juga Shift Manager
iaitu Encik Choong Fook Sang.
Q : Adakah terdapat apa-apa masalah pada syif awak yang patut
direkodkan dalam report Daily Production untuk 9.10.2003?

A : Semua data nitrogen yang dicatitkan oleh QCI Encik Fauzi
pada syif tersebut dari 10 malam hingga 7 pagi menunjukkan
semua bacaan adalah dalam tahap yang dibenarkan. Saya
tidak diberitahu atau tahu mengenai sebarang masalah
dimana tahap nitrogen berada di bawah tahap yang
dibenarkan. Lapuran QCI En. Fauzi menyatakan semua
bacaan dan sampling yang dibuat olehnya adalah
memuaskan. Selaras dengan itu saya mengesahkan Daily
Production Report berbanding dengan apa yang direkodkan
oleh En. Fauzi.
Yang Menuntut Kedua di dalam Penyataan Saksi memberikan
keterangan seperti berikut;
Q : Sila beritahu Mahkamah apa yang berlaku pada syif malam
9.10.2003?
A : Pada malam itu saya bekerja dari pukul 10 malam sehingga 7
pagi keesokannya. Tiada masalah nitrogen di bawah
spesifikasi dilapurkan oleh QC Inspector (QCI).

A : Boleh, bergantung kepada sample yang diambil olehnya.
Q : Adakah anda memeriksa laporan yang dibuat oleh QCI Encik
Fauzi berhubung dengan QC sampling?
A : Laporan QCI untuk syif tersebut menunjukkan bahawa ianya
di dalam tahap spesifikasi yang dibenarkan.
Q : Adakah anda menerima apa-apa laporan atau informasi
tentang masalah 'soft can' iaitu bahawa tahap spesifikasi
semasa bertugas pada 9.10.2003?
A : Pada masa syif tersebut tidak.

A : Saya hanya dapat tahu tentang isu 'soft can' tersebut apabila
saya melaporkan diri untuk syif pada pukul 10 malam pada

anda terima daripada QC Inspector Encik Fauzi?
A : Ya, saya menandatangani report itu.
Q : Adakah ini menandakan anda setuju dengan laporan itu?
A : Semua rekod yang dicatitkan oleh QCI Encik Fauzi pada syif
tersebut dari 10 malam hingga 7 pagi menunjukkan semua
bacaan adalah dalam tahap yang dibenarkan. Saya tidak
diberitahu atau tahu mengenai sebarang masalah dimana
tahap nitrogen berada di bawah tahap yang dibenarkan.
Report QCI En. Fauzi menyatakan semua bacaan dan
sampling yang dibuat olehnya adalah memuaskan. Selaras
dengan itu saya mengesahkan report itu berbanding dengan
apa yang direkodkan oleh E. Fauzi.
Dari keterangan saksi-saksi di atas, tin-tin tersebut menjadi
lembik disebabkan kekurangan nitrogen. Dari keterangan dokumen
iaitu “Retort Line QC Report” di COB-2 mukasurat 5, mencatitkan
spesifikasi yang ditetapkan oleh Syarikat untuk kandungan Nitrogen
(N2) adalah di antara 0.6 ke 1.4 kg/cm @30°C. Ini disahkan oleh
saksi-saksi Syarikat dan Yang Menuntut.
Di dalam keterangan COW-1 mengatakan seperti berikut;
Q : Do you agree at page 5 of COB-2, bottom chart, at right hand
side last column at Nitrogen gas which shows at 5.35 am the
reading being 0.90/0.85, though the pressure is low,
production can still go on and the Nitrogen level is within
specifications?
A : If we follow specifications, Yes, can.
Q : Would you agree that the production has to be stopped if the
Nitrogen level falls below 0.6?
A : Yes, I agree.

Q : Would you agree that in COB-2 page 10 the QC Inspector
does not state what is the Nitrogen level that made the can
soft?
A : Yes, true.
Q : COB-1 and COB-2: Is there any report from the QC
Inspector, En. Fauzi, to show that the Nitrogen pressure was
lower than specification?
A : No.
Q : Therefore, would you agree that the First and Second
Claimants had no report from En. Fauzi that the Nitrogen level
was below specification?
A : Yes, I agree.
Q : In COB-2 pages 2 and 5, the Nitrogen level was within the
specifications?
A : Yes, true.
Q : In COB-2 page 5 we already confirmed N2 was within
specifications. COB-2 page 7: “at 6 after retorting (check
hourly): the checking was also done and it shows the N2 was
within specifications?
A : The report shows that the QC inspector did inspection every
hour. N2 was still within specifications.
Saksi Kedua Syarikat, Chong Fook Sang, COW-2 mengatakan;
Q : To the best of your knowledge is it that the N2 pressure
acceptable level is 0.6, to 1.4?
A : Yes.
Q : At N2 gas 0.6 to 1.4 column in COB-2 page 5 writing below
that: do you agree, all the N2 level stated there in the last
column is within specifications.
A : Based on the report, yes.

Q : Would you agree in light of these 2 documents, had there
been low or no N2, the machine would have rejected the
cans?
A : Yes, the machine would have rejected the cans.
Q : In the light of your testimony, since the N2 level is within
acceptable levels, there is no reason for the Company to stop
production?
A : Based on the report, yes.
Saksi ketiga Syarikat, Tan Bee Chin, COW-3 dalam keterangan
beliau mengatakan seperti berikut;
Q : Both COW-1 and COW-2 testified that N2 gas level should
read between 0.06 - 1.4 as indicated in page 5, it should not
fall below 0.06. Are you refuting their evidence?
A : No, I am not refuting their evidence.
Q : COB-2 page 5, the Company document that N2 level to be
between 0.6 – 1.4 is wrong?
A : It is correct.
Q : Refer COW-3 w/s Q &A9: The reading 0.9 / 0.85. Is that
reading within specification?
A : Yes.
Q : In the light of your testimony, since the N2 level is within
acceptable levels, there is no reason for the Company to stop
production?
A : Based on the report, yes.
Yang Menuntut Pertama memberikan keterangan bahawa;
Q : Rujuk COB-1 m.s. 1 – di bawah shift Manager tandatangani.
Apa ertinya?

A : Apabila COB-1 Manager tandatangani maksudnya beliau
berpuashati dengan kandungan “Daily Production Report dan
beliau sahkan sebagai benar”.
Q : Rujuk COB-1 m.s. 1 siapa sign?
A : Shift Manager Chong Fook Sang (COW-2).
Q : Sepanjang pekerjaan dengan Syarikat apakah keperluan
tahap N2?
A : 0.6 – 1.4.
Q : Apabila tahap N2 jatuh ke tahap 0.80 perlukah berhentikan
produksi?
A : Tidak perlu.
Begitu juga keterangan Yang Menuntut Kedua bahawa;
Q : Dalam keterangan kamu bacaan N2 0.6 – 1.4 boleh diterima?
A : Ya.
Berdasarkan kepada keterangan saksi-saksi seperti di atas dan
juga keterangan dokumentar adalah jelas bahawa keperluan tahap
nitrogen untuk pengeluaran (production) adalah di antara 0.6 – 1.4.
Semasa shift Yang Menuntut, tahap nitrogen berada pada tahap yang
ditentukan oleh Syarikat dan ini jelas di dalam COB-2 mukasurat 5.
Memandangkan tahap nitrogen berada pada tahap yang dibenarkan,
menurut keterangan saksi-saksi Syarikat tidak ada sebarang keperluan
untuk menghentikan pengeluaran (production). Malah COW-1 sendiri
telah menandatangani “Daily Production Report” di COB-1, mukasurat
1 tanpa sebarang nota negatif (adverse remark). Laporan Retort Line
QC Report di muka surat 5, COB-2 menunjukkan tahap nitrogen
berada pada tahap yang dibenarkan dan tiada sebarang arahan dari
QC Inspector, Encik Fauzi untuk menghentikan pengeluaran.

Saksi Syarikat, COW-3 telah memberikan keterangan bahawa
tahap nitrogen sepatutnya melebihi tahap 0.6 – 1.4 dan kedua-dua
Yang Menuntut telah diarahkan untuk mematuhi arahan tersebut.
COW-3 mengatakan;
Q : Do you know that in this case that the cans has not been up
to the Company's specification.
A : Yes, I am aware.
Q : What is that not up to the Company's specification which
cause the cans to dent?
A : Low nitrogens.
Q : Refer to COB-2 page 5 at the lower bracket, at the last item,
“N2 gas 0.6 – 1.4”. What it means 0.6 – 1.4?
A : That is our set parameters for N2. N2 here mean nitrogen.
Q : The nitrogen gas level must be between 0.6 – 1.4, is it
correct?
A : It is not correct because during that period we are
experimenting the right set up. We are adjusting the N2
level, not experimenting.
Q : Is there any documents in this Court to substantiate that 0.6
– 1.4 is the adjusting of the nitrogen level?
A : Yes.
Q : Where, please look at COB1 & COB2?
A : At page 8, COB-2, the same table where it is stated 0.8, 0.9
we state to inform the PS (Supervisor) to adjust.
Q : Both COW1 & COW-2 testified that N2 gas level should read
between 0.6 – 1.4 as indicated in page 5, it should not fall
below 0.6. Are you refuting their evidence?

Q : COB2 page 5, N2 gas 0.6, is it the minimum level stated
there?
A : Yes, it is stated there.
Q : Since you are not the maker, you do not know why the N2
level is stated 0.6?
A : I disagree.
Q : Do you know who is the author of COB-2, page 5?
A : My subordinate, Quality Control Superintendant Wong Ho
Boon and Azizah.
Q : Are they both still with the Company?
A : Azizah is still with the Company.
Q : When COB-2 page 5 is churned out, do you have sight of it?
A : Of course, Yes.

Q : Do you know why 0.6 is stated there. COB-2 page 5?
A : We follow the standard provided by Brand owner, F&N.
Q : COB-2 page 5 states that F&N states the minimum Nitrogen
level is 0.6?
A : Yes.
Q : What is the maximum Nitrogen level?
A : 1.4
Q : COB-2 page 5, F & N prescribes the N2 level to be between
0.6 – 1.4?
A : Yes.
Q : COB-2 page 5 – the same column, the reading, in the
column there is no N2 level stated there, below 0.6?
A : Yes.
Q : As far as the Nitrogen level is not below 0.6, the production
can carry on?
A : No, I disagree.
Q : COB2 page 5 at the same column, is there any documents
which shows that at 0.6 or 0.7 or 0.8 or 0.9, production will
stopped?
A : Yes, at the lowest part of the page.
Q : My question is to stopped production, is there any
documents showing the instruction? Manual or guideline?
A : Yes, there are.

Apabila diteliti keterangan COW-3 dengan COW-2 dan COW-1
jelas terdapat percanggahan. Menurut COW-1 dan COW-2, tahap
nitrogen 0.6 – 1.4 adalah spesifikasi yang dibenarkan dan langsung
tiada keterangan bahawa tahap nitrogen tersebut telah dinaikkan ke
0.9 – 1.4 seperti yang didakwa oleh COW-3. COW-1 dan COW-2
sebenarnya mempertikaikan kesahihan dokumen-dokumen yang
menunjukkan tahap nitrogen adalah 0.6 – 1.4. Mereka berpendapat
bahawa dokumen-dokumen tersebut adalah tidak benar dan tahap
nitrogen sebenarnya berada pada tahap yang lebih rendah dari 0.6
untuk menyebabkan kelembikan tin-tin minuman tersebut.
COW-3 juga mengatakan bahawa sebenarnya pihak Syarikat
sedang menguji tahap yang sewajarnya untuk kandungan Nitrogen
dan selepas ujian-ujian (experimenting) tersebut, pihak Syarikat telah
memutuskan bahawa tahap minima Nitrogen adalah 0.9 – 1.4.
Menurut COW-3 perkara ini dicatit dalam QC Supervisor
Communication Book tetapi pihak Syarikat telah gagal mengemukakan
dokumen ini walaupun penangguhan telah diberikan oleh Mahkamah
ini untuk mendapatkan dokumen ini. Begitu juga dengan
Manual/Guideline untuk menghentikan pengeluaran. Menurut Peguam
yang bijaksana bagi pihak Syarikat, beliau telah cuba mendapatkan
dokumen-dokumen tersebut tetapi pihak Syarikat tidak dapat
mengesan dokumen-dokumen tersebut. Oleh kerana dokumen-
dokumen ini tidak diperolehi dan saksi-saksi COW-1 dan COW-2
langsung tidak membangkitkan isu ini, Mahkamah berpendapat tidak
ada sebarang arahan dari pihak Syarikat supaya tahap minima
Nitrogen dinaikkan dari 0.6 kepada 0.9. Oleh itu pihak Syarikat telah
gagal untuk membuktikan bahawa spesifikasi Syarikat untuk tahap
Nitrogen yang minima adalah 0.9 dan bukannya 0.6.

Mahkamah ini juga telah meneliti Proses Kerja untuk penyediaan
minuman tin iaitu CO-1 yang menunjukkan bahawa sekiranya tahap
Nitrogen berada pada tahap yang rendah, dengan sendirinya mesin
tersebut pada tahap ADR-1 dan ADR-2 akan menolak (reject) tin-tin
tersebut. Tetapi dalam kes ini perkara tersebut tidak berlaku. Oleh
itu seperti keterangan COW-1 dan juga Yang Menuntut menunjukkan
terdapat kemungkinan bahawa mesin-mesin tersebut yang sebenar
defektif dan bukannya atas kecuaian kedua-dua Yang Menuntut.
COW-1 semasa pemeriksaan balas telah mengatakan;
Q : Was the N2 pressure cause by machine default?
A : Yes.
Q : Between 2003 to 2005 or 2006, are you aware this
equipment in the Company often breaks down or is
defective because the N2 pressure is low?
A : Yes.
Q : Is there a possibility that the Nitrogen level due to the
pinhole leaking during the retesting process?
A : CLBS page 97: it's in 2005: portion in writing i.e. from
“Nitrogen problem. Purging....” at page 98 it shows that 28
cans were rejected. At page 99 it shoes that 74 were
rejected. At page 100 it shows Engineering problem and
under maintenance by Engineering Department. At page
101, N2 still under Maintenance by Engineering
Department. At page 102 it shows N2 under maintenance.
At page 103 it shows there were 127 rejects. At page 104
it shows a Nitrogen nozzle clog. At page 105 it shows 163
rejects. At page 106 it shows that N2 dosing system
malfunction, nozzle clog. Reject was 189. At page 107 it
shows N2 in consistent supply. Rejects were 281. Page
108 shows 90 rejects, page 109 states N2 inconsistent
supply. 472 rejects. Page 110 shows N2 nozzle clog. Total
rejects of 245. page 10 to 24 of CLBS referred to i.e. for
24
years 2007 which shows problem again with N2. Can you
assist Court: are you aware that this Company machine has
problems with the N2 aspect, generally.
A : In the past years (tahun 2 kebelakang) I was aware of this
problem.
Q : There was rejection of cans as well?
A : Yes.
Keterangan COW-1 ini memperkukuhkan lagi keterangan COW-2
bahawa memang terdapat kerosakan (default) pada mesin tersebut.
COW-2 mengatakan;
Q : Was the N2 pressure caused by machine default?
A : Yes.
Q : Between 2003 to 2005 or 2006, are you aware that this
equipment in the Company often breaks down or in
defective because the N2 pressure is low?
A : Yes.
Oleh itu berdasarkan pada keterangan tersebut Mahkamah tidak
boleh menolak kemungkinan berlakunya kerosakan pada masa-masa
tersebut. Oleh itu kenyataan pihak Syarikat bahawa kecuaian kedua-
dua Yang menuntut yang tidak menjalankan tugas dengan sempurna
telah menyebabkan 51,500 tin yang dihasilkan terpaksa dimusnahkan
tidak dapat diterima oleh Mahkamah ini. Keterangan pihak Syarikat
adalah berdasarkan keterangan tidak langsung (circumtancial
evidence) bahawa tidak ada sebab lain yang menyebabkan kelembikan
tin-tin tersebut kecuali kecuaian kedua-dua Yang Menuntut untuk
menentukan tahap Nitrogen berada pada spesifikasi yang ditentukan
oleh Syarikat. Tetapi melalui keterangan COW-1 dan COW-2,

kerosakan mesin pernah berlaku sebelum ini dan kemungkinan ini
berlaku sekali lagi dalam kes ini tidak boleh ditolak.
Di dalam kes Mui Bank Bhd. Johor v Tee Puat Kuay [1993]
3 MLJ 239, Mahkamah Tinggi telah menegaskan di mukasurat 245
bahawa;
“Where the applicant is relying on circumstances evidence,
the onus upon it is a very heavy one and that evidence
must point irresistibly to the guilt of the respondent. Mere
suspicion, as in this case, therefore could not be accepted
as suggestion ground for dismissal.”
Mahkamah ini juga mengambil maklum (take note) bahawa
pihak Syarikat telah gagal untuk mengatakan tahap Nitrogen (N2)
yang dispesifikasikan oleh Syarikat samada di dalam tuduhannya
terhadap Yang Menuntut ataupun di dalam pleading mereka. Pihak
Syarikat hanya mengatakan tahap Nitrogen berada pada tahap yang
rendah menyebabkan berlakunya kelembikan pada tin-tin tersebut.
Kegagalan ini menyebabkan tuduhan terhadap Yang Menuntut adalah
defektif seperti yang dinyatakan oleh Mahkamah ini di permulaan
Award ini.
Remedi
Setelah Mahkamah memutuskan bahawa pembuangan kerja
pihak Yang Menuntut adalah tanpa sebab dan alasan yang adil maka
Mahkamah seterusnya perlu menentukan remedi yang bersesuaian
kepada Yang Menuntut.
Adalah menjadi prinsip undang-undang yang termaktub, remedi
yang boleh diberikan kepada pembuangan kerja tanpa alasan adil dan
bersebab adalah perlantikan semula pekerja tersebut ke jawatan
asalnya. Walaupun begitu, dalam kes ini setelah mempertimbangkan

keterangan yang dikemukakan, Mahkamah berpendapat bahawa
perlantikan semula Yang Menuntut ke jawatan asal bukan remedi yang
bersesuaian dalam kes ini memandangkan kedua-dua Yang Menuntut
telah dibuang kerja hampir 9 tahun yang lepas serta kepercayaan di
antara kedua-dua pihak telah terjejas akibat dari kes ini. Oleh itu
pampasan kepada perlantikan semula adalah lebih sesuai dalam kes
ini.
Isu remedi ini telah dijelaskan di dalam kes Koperasi
Serbaguna Sanya Bhd. (Sabah) v Dr. James Alfred (Sabah) &
Anor [2000] 3 CLJ 758 di mana Mahkamah Rayuan telah mengatakan
di muka surat 766 sebagai berikut;
“In Industrial law, the usual remedy for unjustified
dismissal is an order of reinstatement. It is only in rare
cases that reinstatement is refused. For example, as
here, where the relationship between the parties has
broken down so badly that it would not be conducive to
industrial harmony to return the workman to his place of
work. In such a case, the Industrial Court may award
monetary compensation. Such an award is usually in two
parts. First, there is usual award for the arrears of wages,
or backwages, as it is sometimes called. It is to
compensate the workman for the period that he has been
unemployed because of the unjustified act of dismissal.
Second, there is an award of compensation in lieu of
reinstatement.”
Yang Menuntut layak mendapatkan bayaran gaji tertunggak
untuk tempoh maksima 24 bulan. Untuk remedi ini Mahkamah perlu
mengambilkira faktor-faktor “post-dismissal” dan juga faktor
salahlaku sertaan (contributory misconduct) oleh Yang Menuntut. Ini
telah diputuskan dalam kes Wong Yen Hock v Syarikat Hong
Leong Assurance Sdn. Bhd. & Anor [1995] 3 CLJ 344 di mana Yang
Arif Mohd Azmi FCJ di muka surat 348 mengatakan;

“We only needed to add that in assessing compensation in
lieu of reinstatement, it was the practice of the Industrial
Court (so we were told) to take into consideration any
contributory misconduct of the claimant. We were of the
opinion that such practice was perfectly justified
in appropriate cases so that the employee's own
misdemeanour or unsatisfactory conduct might be taken
as contributory factor towards the assessment of
compensation for the wrongful dismissal. In our view
such practice was not only consistent with the provision
of s.30(5) of the Industrial Relations Act, which requires
the Industrial Court to act according to equity and good
conscience when making its awards.............”
Yang Menuntut Pertama telah bekerja dengan Syarikat untuk
tempoh hampir 6 tahun iaitu pada 01 November 1997 dan telah
dibuang kerja pada 19 Disember 2003. Gaji akhir beliau ialah
RM2,640.00.
Yang Menuntut Kedua pula telah mula bekerja dengan Syarikat
sejak 10 November 1997 dan telah dibuang kerja pada 19 Disember
2003 iaitu untuk tempoh 6 tahun. Gaji terakhir beliau adalah
sebanyak RM2,264.00.
Dalam mengawadkan bayaran gaji tertunggak, Mahkamah perlu
mempertimbangkan samada terdapat pendapatan selepas
pemecatan kerja dan sekiranya ada, Mahkamah perlu menolak
sesuatu peratusan yang munasabah daripada gaji tertunggak.
Dalam kes ini, Yang Menuntut Pertama telah memberikan
keterangan bahawa selepas pemecatan, beliau ada berniaga dan juga
membuat kerja-kerja kampung. Pada 2008 beliau telah bekerja
di Novalab, Port Klang selama 6 bulan dengan gaji sebanyak
RM1,800.00 sebulan. Selepas itu beliau telah bekerja tetap
di Etika Dairies sebagai Production Supervisor. Gaji beliau sekarang

adalah sebanyak RM2,200.00 sebulan. Yang Menuntut kedua pula
telah bekerja sebagai “Waiter” di Restoran Fasta-Fasta di Mutiara
Damansara mulai Januari 2004. Beliau dibayar gaji dalam lingkungan
RM1,600.00 – RM1,800.00 sebulan. Selepas 4 tahun, Restoran Fasta-
Fasta telah menutup operasinya dan beliau telah berniaga di pasar
malam membantu rakannya berniaga. Purata pendapatan beliau
dalam lingkungan RM1,000.00 sebulan.
Mahkamah ini juga berpendapat bahawa di dalam kes ini jelas
terdapat salahlaku sertaaan (contributory misconduct) oleh kedua-dua
Yang Menuntut. Oleh itu, berdasarkan kedua-dua faktor di atas,
adalah wajar dan adil dalam kes ini untuk memerintahkan Syarikat
membayar Yang Menuntut gaji tertunggak sebanyak 10 bulan
berdasarkan gaji bulanan terakhir Yang Menuntut seperti berikut;
Yang Menuntut Pertama
RM2,640.00 x 10 bulan = RM26,400.00.
Yang Menuntut Kedua
RM2,264.00 x 10 bulan = RM22,640.00.
Untuk pampasan kepada perlantikan semula adalah menjadi
norma Mahkamah Perusahaan untuk mengawadkan pampasan
tersebut berdasarkan perkiraan sebulan gaji untuk setiap tahun genap
perkhidmatan pekerja dengan Syarikat. Dalam kes ini, Yang Menuntut
telah berkhidmat dengan Syarikat untuk tempoh masa hampir
6 tahun. Oleh yang demikian, Mahkamah memerintahkan pampasan
kepada perlantikan semula sebanyak 6 bulan seperti berikut;

RM2,640.00 x 6 bulan = RM15,840.00.
Yang Menuntut Kedua
RM2,264.00 x 6 bulan = RM13,584.00.
Perintah Muktamad
Keseluruhan Award adalah;
Yang Menuntut Pertama: RM26,400.00 + RM15,840.00
= RM42,240.00.
Yang Menuntut Kedua : RM22,640.00 + RM13,584.00
= RM36,224.00.
JUMLAH = RM78,464.00. ==========
Pihak Syarikat dengan ini diperintahkan untuk membayar jumlah
keseluruhan sebanyak RM78,464.00 setelah menolak bayaran wajib
(statutory deduction) sekiranya ada melalui Peguam Yang Menuntut,
Tetuan P. Kuppusamy & Co., dalam tempoh 30 hari dari tarikh Award
ini diperturunkan.
