SHELL 125 YEARS PWP (SHELL HERITAGE CANISTERS) TERMS AND CONDITIONS 1. The promotion period of the Shell 125 Years PWP (Shell Heritage Canisters) (“Promotion”) is

from 18 September 2016 to 31 October 2016; both core dates are inclusive (“Promotion Period”).

2. The Promotion is organised collectively by Shell Malaysia Trading Sdn Bhd and Shell Timur Sdn Bhd (collectively, referred to as “Shell”) and is open to all Shell customers (“Customers”) at all Shell Select and Kedai Stores (where applicable) in Malaysia (“Shell Stations”).

3. The purchase or redemption (where applicable) of the Shell Heritage Big Canisters, Shell Heritage Mini Canisters, Shell Tanker Canister and Shell Helix Car Care Canister (collectively, referred to as the “Shell Heritage Canisters”) is subject to (i) the Release Date of the Shell Heritage Canisters (as stipulated in Clause 4 below) and (ii) the minimum spend indicated in Clause 5 below and (iii) is only valid while stocks last.

4. Shell Customers may purchase or redeem (where applicable) the Shell Heritage Canisters in accordance with the pre-requisites in Clause 3, only once it has been released in accordance with the following release dates of the weeks specified below (“Release Dates”):

5. The purchase or redemption of each of the Shell Heritage Canisters and the Shell Heritage

Mini Canister Collector Case can be carried out in accordance with the following:

(A) Purchase of Shell Heritage Big Canister and Shell Tanker Canister

(i) With a minimum spend of RM40 and above in a single receipt on any Shell fuels during the Promotion Period, Shell Customers are entitled to purchase one (1) model of the Shell Heritage Big Canister or Shell Tanker Canister (depending on the Release Date) at a price of RM12.90 for each model.

(ii) The purchase of the Shell Heritage Big Canister comes with one (1) free Shell Fridge Magnet.

(iii) The purchase of the Shell Tanker Canister comes with one (1) free Shell Sports Towel.

(iv) The purchase of the Shell Heritage Big Canister or Shell Tanker Canister is available at all Shell Stations.

(B) Purchase of Shell Helix Car Care Kit Canister

(i) With a minimum spend of one (1) bottle of Shell Helix HX5 Lubricants (3-Litre) or (4-Litre) in a single receipt during the Promotion Period, Shell Customers are entitled to purchase one (1) model of the Shell Helix Car Care Kit Canister at a price of RM12.90 for each model.

(ii) The purchase of the Shell Helix Car Care Kit Canister comes with a free sponge; Shell branded cloth and air freshener.

(iii) The purchase of the Shell Helix Car Care Kit Canister is available at all Shell Stations.

(C) Redemption of Shell Helix Car Care Kit Canister

(i) With a minimum spend of one (1) bottle of Shell Helix Ultra (4-Litre) or Shell

Helix HX7 (4-Litre) in a single receipt during the Promotion Period, Shell Customers are entitled to redeem one (1) model of the Shell Helix Car Care Kit Canister free of charge.

(ii) The redemption of the Shell Helix Car Care Kit Canister is only valid while stocks last and Shell Customers will not be entitled to purchase any other Shell Heritage Canisters and/or the Shell Heritage Mini Canister Collector Case in addition to the exercise of this redemption.

(iii) The redemption of the Shell Helix Car Care Kit Canister comes with a free sponge; Shell branded cloth and air freshener.

(iv) The redemption of the Shell Helix Car Care Kit Canister is available at all Shell Stations.

(D) Purchase of Shell Heritage Mini Canister

(i) With a minimum spend of either (i) RM6 and above in a single receipt of any

Shell SELECT items (excluding Touch n Go, E-Pay, Tobacco, Alcohol & Shell Lubricants) or (ii) any amount in a single receipt on any Shell items under a SELECT promotion (for example: Buy 2x Chipsmore 88g for RM4.00) during the Promotion Period, Shell Customers are entitled to one (1) model of the Shell Heritage Mini Canister (depending on the Release Date) at a price of RM7.90 for each model.

(ii) The purchase of the Shell Heritage Mini Canister comes with one (1) free Shell Keychain.

(iii) The purchase of the Shell Heritage Mini Canister is only available at Shell Select stores at the Shell Stations.

(E) Purchase of the Shell Heritage Mini Canister Collector Case

(i) One (1) unit of the Shell Heritage Mini Canister Collector Case can be

purchased at a price of RM29.90.

(iv) The purchase of the Shell Heritage Mini Canister Collector Case is only available at Shell Select stores at the Shell Stations.

6. For the avoidance of doubt and in accordance with the respective Release Dates:

(a) each Shell customer can only purchase a maximum of three (3) Shell Heritage Big Canisters, Shell Heritage Mini Canisters and Shell Tanker Canister for each sale transaction concerning the purchase of the relevant Shell fuels or SELECT items as specified above. For example:

(i) when a Shell Customer purchases Ringgit Malaysia One Hundred Sixty

(RM160.00) worth of the relevant Shell fuels listed out in Clause 5 above, the maximum purchase is three (3) Shell Heritage Big Canisters and/or Shell Tanker Canister, NOT four (4) Shell Heritage Big Canisters and/or Shell Tanker Canister; or

(ii) when a Shell Customer purchases Ringgit Malaysia Twenty Four (RM24.00)

worth of the relevant Shell SELECT items listed out in Clause 5 above, the maximum purchase is three (3) Shell Heritage Mini Canisters, NOT four (4) Shell Heritage Mini Canisters.

(b) there is however no limit to the amount of Shell Helix Car Care Canisters that can be

purchased by the Shell Customer as long as the relevant pre-requisites in Clause 4 has been satisfied. For example: (i) a Shell Customer will be eligible to purchase four (4) models of the Shell Helix

Car Care Kit if the Shell Customer has purchased four bottles of Shell Helix HX5 (4Litre); or

(ii) a Shell Customer will be eligible to redeem four (4) models of the Shell Helix Car Care Kit if the Shell Customer has purchased four bottles of Shell Helix Ultra (4Litre).

7. In order to purchase the Shell Heritage Canisters, Shell Customers must present, during the

Promotion Period, the original sales receipt(s) of their respective purchases within a period of seven (7) days after the purchase of the relevant Shell fuels, lubricants or SELECT items at the same Shell retail station where such purchases were made. For example, Shell customer received his/her original sales receipts on 18 September 2016, his or her receipt will not be entitled to buy any Shell Heritage Canisters after 24 September 2016, 23.59:59.

8. Shell Customers will not be entitled to any BonusLink points with the purchase of any Shell

Heritage Canisters and the Shell Heritage Mini Canister Collector Case.

9. Any model of the Shell Heritage Canisters and the Shell Heritage Mini Canister Collector Case purchased during the Promotion Period is strictly non-returnable and non-exchangeable.

10. Shell Fleet Card Users are eligible to participate in this Promotion when they use their fleet card for transaction.

11. For the avoidance of doubt, any of the prices indicated in this Terms and Conditions are

inclusive of Goods and Services Tax. 12. Shell reserves the right at its absolute discretion to vary, delete or add to any these Terms and

Conditions without prior notice or to terminate this Promotion at any time without notice or liability.

13. These Terms and Conditions, as may be amended from time to time pursuant to Clause 11 above, shall prevail over any provisions or representations contained in any other promotional material or advertising of this Promotion.

14. All decisions made by Shell in respect of this Promotion or in the event of any dispute are final.

15. In the event where there is any inconsistency(ies), conflict(s), ambiguity(ies) or

discrepancy(ies) between English and Bahasa Malaysia versions of these Terms and Conditions, the English version of these Terms and Conditions shall prevail.

16. Shell reserves the right to cancel, terminate or suspend this Promotion with or without prior

notice. In the avoidance of doubt, cancellation, termination or suspension by Shell of this Promotion shall not entitle Shell Customers to any claim or compensation against Shell for any and all and all losses or damage suffered or incurred by Shell Customers as a direct or indirect result of the act of cancellation, termination or suspension.

17. In no event will Shell and its Affiliates be liable for any loss or damages including without

limitations, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties howsoever arising whether in contract, tort, negligence or otherwise, in connection with this Promotion, even if Shell has been advised of the possibility of such damages are expressly excluded.

18. For the purpose of this Terms and Conditions, “Affiliate” means a company which directly, or

indirectly through one or more intermediaries, controls, is controlled by, or is under common control with Shell. Relevant to this, “control” means the direct or indirect ownership of an aggregate fifty percent (50%) or more of voting capital.
