CIVIL REGISTRATION GUIDE

Modes of proceeding

There are 2 modes of beginning civil proceeding in Syariah Court i.e:

(a) Summons(b) Applications

Summons is every civil action or proceeding in a court that began with summons enclosed with a statement of claim.An application is every civil action or proceeding in a court that began with an application notice enclosed with affidavit in support.

LIST OF CASES BEGAN IN THE MODE OF APPLICATION PRESCRIBED UNDER THE ISLAMIC FAMILY LAW ACT/ENACMENT/ ORDINANCE

• Consent for solemnization of marriage of a minor• Appointment of wali am• Order for registration of marriage solemnized

contrary to law • Presumption of death • Appointment of a guardian for the protection and

preservation of a minor’s property• Order for removal of a guardian for the protection

and preservation of a minor’s property• Leave for disposal of a minor’s property• Order for use of Capital Property to support a minor• Prohibition order relating to a minor’s property• Injunction restraining the taking of a child out of

Malaysia• Order to set aside, and an injunction restraining, the

disposal of property to defeat claim for maintenance• Injunction against molestation by spouse of former

spouse• Recognition of marriage contracted outside the

Federal Territories (Acknowledgement of Paternity)• Confirmation of acknowledgement of paternity by

woman in ‘iddah ( Distribution of estate)

LIST OF CASES PROCEEDING TO BE BEGUN BY SUMMONSEvery civil action or proceeding shall be begun by summons accompanied by statement of claim except otherwise stated by the law. They are as follows:

Claim for divorce Claim for divorce under stipulation (ta’liq)

Claims for damages caused by one party refuses to marry the other after betrothal

Claim for fasakh Claim for muta’ah

Claim for property jointly acquired by spouses during subsistence of marriage

Claims for maintenance of wife’ Claims for the disable person

Claim for security for maintenance Claims for maintenance during ‘iddah period Claim for variation of maintenance order Claim for recovery of arrears of maintenance Claim for maintenance of a child

Claim for variation of custody and child maintenance order

Claims for the custody of a child Claims for garnishment/ hiwalah Claim for judgment debtor.

REGISTRATION PROCEDUREi. Each registration shall be presented by applicant

himself or his representative to the Chief Registrar or Registrar or Assistant Registrar.

ii. Each Registration document shall be presented in four copy

birth and others)d) Payment of the required e) Wakalah of the Syarie Lawyer for those who

is represented by a Syarie Lawyerf) Reference latter from district marriage

registrar toward syarie jugde for wali am, under age marriage and widow confirmation application.(Support letter from the Registrar of Marriage)

iv. Registration for summons case shall be enclosed with:a) Summonsb) Statement of claimc) Bundle of document d) Payment of the requirede) Wakalah of the Syarie Lawyer for those who

is represented by a Syarie Lawyer

v. Only the complete registration and accordingly by the law will be accepted

CONDITION FOR CLIENT CASE REGISTRATION

All Muslims who are legally married based on the Syariah law and a resident to the place where they live can register their application or claim at any branch of the Syariah Court nearby.

Note:

Case registration can be done by the applicant themselves or through the service of a Syarie lawyer for those who are capable or through the Legal Aid Bureau for those who are incapable.
