Berdasarkan keterangan pemohon, fungsi utama barangan ini secara asasnya adalah untuk soil stabilizing, pulverizing or cold recycling with optional cab and additive system.

Mengikut pemohon juga, kegunaan utama barangan ini adalah to loosen up spoilt road base bagi road construction atau road repair/maintenance. Tanah-tanah tersebut akan dipecah, digembur serta diratakan dan seterusnya dipadatkan dengan menggunakan roller.Bagaimanapun lapisan asphalt yang rosak (spoilt asphalt) is generally cut by a Cold Planer/Milling machine.

Barangan ini sesuai diperjeniskan di bawah kod tarif 8430.50 000 sebagai other machinery for earth, minerals or ores, self propelled berdasarkan alasan-alasan berikut:

i. Barangan merupakan sejenis self propelled machine yang dilengkapi dengan engine, drive systems, operator station, wheels, tires and cutter.

ii. Barangan digunakan untuk kerja-kerja memotong, memecah dan menggemburkan

tanah (loosen up spoilt road base) bagi road construction atau road repair/maintenance manakala kerja-kerja untuk pemotongan asphalt layer yang telah rosak akan dijalankan oleh mesin yang lain iaitu Cold Planer/Milling machine.

Analisa pakar mengesahkan barangan mengandungi maltodextrin serta 2.2% glucose dan 9.5% maltose.Ia juga mengandungi nilai ”reducing sugar content” sebanyak 11.7%.

Fakta :

Barangan ini sesuai diperjeniskan mengikut GIR 1 & 6 di bawah kod tariff 1702.90 900 ( Perintah Duti Kastam 2012 ) sebagai other sugar berdasarkan alasan-alasan berikut:

Ketetapan:

• Analisis pakar mengesahkan barangan ini mengandungi campuran maltodextrin, glucose dan maltose. Ia juga mengandungi nilai ”reducing sugar content” sebanyak 11.7%.

• Kod tarif 1702.30 200 tidak dapat dipertimbangkan kerana barangan ini tidak memenuhi keperluan ”reducing sugar content” sebanyak tidak kurang dari 20%. Perkara ini diperjelaskan di dalam EN 2012 muka surat IV-1702-1 seperti berikut : (A) OTHER SUGARS (3) Glucose, which occurs naturally in fruits and honey. Together with an equal part of fructose it constitute invert sugar.

Kegunaan peralatan adalah untuk mengumpul data dan maklumat (membaca meter) di tapak atau di luar pejabat. Data tersebut akan dihantar ke host server secara kelompok selepas kembali ke pejabat.

Barangan ini selepas diimpot akan di bekalkan dengan perisian/software yang dipanggil spot meter reading system (SMRS) yang akan dibangunkan oleh syarikat (to be installed inside memory card) dan akan berhubung dengan Perisian di Host server. Setiap hari data pelanggan akan di muat turun kedalam (download) peralatan ini melalui Wifi atau bluetooth di pejabat. Seterusnya pembaca meter akan ke tapak dan memulakan kerja. Pembaca meter akan memilih data pelanggan dan memasukkan no dail bacaan ke dalam peralatan ini . Pengiraan akan dilakukan oleh applikasi perisian di peralatan tersebut dan seterusnya menghantar data ke pencetak QL420 dengan bluetooth untuk mencetak bill. Setelah selesai membuat bacaan, data dari peralatan ini akan di hantar masuk di pejabat melalui hubungan Wifi atau bluetooth ke system route application manager. Dalam perisian ini data-data dari komputer bimbit yang lain akan dikumpulkan dan seterus menjana lapuran yang tertentu. Seterusnya proses ini akan berulang pada setiap hari.

Mesyuarat Panel Penetapan Penjenisan telah membuat kajian semula dan memutuskan barangan ini sesuai diperjeniskan mengikut GIR 3(b) di bawah kod tarif 8471.50 000 sebagai processing units, containing storage units, input units and output units in the same housing berdasarkan alasan-alasan berikut:

• Barangan dilengkapi dengan central processing unit. Central processing unit mengikut keterangan dalam en.wikipedia.org adalah seperti berikut:

The central processing unit (CPU, occasionally central processor unit is the hardware within a computer system which carries out the instructions of a computer program by performing the basic arithmetical, logical, and input/output operations of the system.

• Barangan merupakan processing unit terminal yang mempunyai storage unit (memory), input unit (keyboard) dan output unit (LCD panel) dalam housing yang sama.

• Barangan memenuhi ciri-ciri composite good yang mempunyai pelbagai fungsi iaitu sebagai Barcode Reader (heading 8471), Digital Camera (heading 8525), Wireless Communication featuring Wi-Fi and bluetooth (heading 8517), dan Automatic Data Processing Machine with Window Mobile 6.1 Operating System (heading 8471).

• Data/maklumat yang telah diimbas atau dimasukkan melalui keyboard akan disimpan atau diproses dalam terminal. Berdasarkan kegunaan barangan, fungsi utama (essential character) barangan ini adalah sebagai peralatan untuk mengumpul data dan maklumat. Data tersebut akan diproses dan disalurkan ke pencetak dan peralatan lain seperti server melalui WIFI / bluetooth / USB port (melalui docking station).

• Rujukan kepada pakar mengesahkan barangan ini pada masa sekarang tidak dikategorikan di bawah alat komunikasi.

• Barangan memenuhi kriteria part of an automatic data processing machines berdasarkan ENHS 2007 Nota 5(C) kepada Chapter 84 mukasurat XVI-84-2 seperti berikut:

(C) Subject to paragraphs (D) and (E) below, a unit is to be regarded as being part of an

automatic data processing system if it meets all of the following conditions : (i) It is of a kind solely or principally used in an automatic data processing system;

(ii) It is connectable to the central processing unit either directly or through one or more other units; and

(iii) It is able to accept or deliver data in a form (codes or signals) which can be used by the system.

• Barangan mendapat liputan dalam ENHS 2007 mukasurat XVI-8471-1 dan XVI-8471-2 yang menjelaskan seperti berikut :

84.71 - Automatic data processing machines and units thereof; magnetic or optical readers, machines for transcribing data onto data media in coded form and machines for processing such data, not elsewhere specified or included).

8471.50 - Processing units other than those of subheading 8471.41 or 8471.49, whether or not containing in the same housing one or two of the following types of unit : storage units, input units, output units

(B) SEPARATELY PRESENTED UNITS

Subject to the provisions of Notes 5 (D) and (E) to this Chapter, this heading also covers separately presented constituent units of automatic data processing systems. These may be in the form of units having a separate housing or in the form of units not having a separate housing and designed to be inserted into a machine (e.g., insertion onto the main board of a central processing unit). Constituent units are those defined in Part (A) above and in the following paragraphs, as being parts of a complete system.

An apparatus can only be classified in this heading as a unit of an automatic data processing system if it :

(a) Performs a data processing function;

(b) Meets the following criteria set out in Note 5 (C) to this Chapter :

(i) It is of a kind solely or principally used in an automatic data processing system;

(ii) It is connectable to the central processing unit either directly or through one or more other units; and

(iii) It is able to accept or deliver data in a form (codes or signals) which can be used by the system.
