OBJECTIVES OF THE TALK

There are many modes of enforcing judgements and

orders. Why choose contempt proceedings?

This talk will help lawyers to understand and decide

when it may be appropriate to enforce orders and

judgements by contempt proceedings.

Mr Balwant will discuss the law on contempt

proceedings generally, and how they are of use in

matrimonial proceedings specifically. He will also

suggest reference e.g., textbooks and books on

precedents to which lawyers may wish to refer.

Practice and procedure will also be discussed, with Mr

Balwant highlighting common mistakes made by

lawyers in this area.

Mr Balwant will also address any other questions from

the participants pertaining to matrimonial matters.

Mr Balwant has been involved in numerous reported

cases including the Federal Court cases of Karunairajah

a/l Rasiah v. Punithambigai a/p Poniah [2004] 2 MLJ 401

and Soon Singh a/l Bikar Singh v. Pertubuhan Kebajikan

Islam Malaysia (PERKIM) Kedah & Anor. [1999] 1 MLJ

489 and the Court of Appeal cases of Chandrasekaran

Thangavelu & Anor. v. AL Annamalai & Anor [2004] 4

MLJ 297 and Sivanes a/l Rajaratnam v. Usha Rani a/p

Subramaniam [2002] 3 MLJ 273,

Mr. Balwant was called to the English Bar on 29.7.1982

and to the Malaysian Bar on 29.8.1983 and is currently

practicing in the legal form of Mesrs. Balwant Singh

Sidhu & Co.

Mr. Balwant is the Contributing Editor of The Annotated

Statutes of Malaya, (MLJ) (The Law Reform (Marriage &

Divorce) Act 1976 (1995) issue and has spoken at

various Conferences, including the 10th Malaysia Law

Conference held at Kuala Lumpur in 1993 and the 11th

Malaysian Law Conference in 2001.

He was also the External Tutor on Civil Procedure for the

Certificate of Legal Practice at University of Malaya

from 1985 to 1991 and the External Examiner of Civil

Procedure for the Certificate of Legal Practice

(Qualifying Board) from 1994 to 1999 and in 2001.
