PENGENALAN & OBJEKTIF BENGKEL
Pengenalan
Hak Milik Strata merujuk kepada hak milik yang dikeluarkan untuk setiap unit bagi sesebuah bangunan yang mempunyai lebih daripada dua unit utama di mana kebenaran bagi memecah bahagi bangunan tersebut telah diluluskan. Misalnya rumah pangsa, kedai dan pejabat.
Hak Milik Strata diadakan untuk menjaga kepentingan pembeli hak milik strata supaya lebih terjamin.
Akta Kanun Tanah (Strata) Penggal 189 telah diluluskan melalui Titah Perkenan Kebawah Duli Yang Maha Mulia Paduka Seri Baginda Sultan dan Yang Di-Pertuan Negara Brunei Darussalam pada tahun 1999 dan mula berkuatkuasa pada 1hb Julai 2009. Akta Strata digubal dengan tujuan untuk membolehkan sesiapa sahaja yang berkeinginan untuk memiliki hartanah berupa unit-unit dalam bangunan di Negara Brunei Darussalam.
Akta Kanun Tanah Strata (Penggal 189), Negara Brunei Darussalam membolehkan pemilik lot tanah memecah bahagi bangunan yang mempunyai lebih daripada dua unit utama, samada secara menegak (vertical) atau mendatar (horizontal). Pecah bahagi ini bermaksud pengeluaran hakmilik berasingan yang dipanggil hakmilik strata bagi tiap-tiap petak (unit) dalam bangunan yang boleh dimiliki oleh sesiapa sahaja. Walaubagaimanapun, kebenaran pecah bahagi bangunan hendaklah diperolehi terlebih dahulu dan bangunan telah siap dibina dan telah mendapat kebenaran (occupation permit (OP)) dari Pihak Berkuasa.
Bengkel ini adalah anjuran bersama Institusi Geomatik Brunei (B.I.G.), Jabatan Ukur dan Jabatan Tanah.
Objektif
Mengetahui amalan terbaik berkenaan Hak Milik Strata daripada Negara-negara luar seperti Australia, Singapura dan Malaysia.
Mengumpulkan pegawai-pegawai (agensi kerajaan) yang bertanggungjawab di dalam pengendalian Hak Milik Strata dan Juruukur Berlesen di dalam satu platform yang membolehkan perkongsian maklumat dan idea.

ABSTRAK
Strata Development was introduced in Singapore almost 50 years ago 1968.
Now, more than 80% of Singapore population lived in strata-titled properties,
such as apartments and condominiums. To date, there are more 1.2 million
strata units created in Singapore.
The Singapore success story on Strata Development is the result of the various
legislations enacted by Government to regulate the construction, selling and
maintenance and management of strata-titled properties.
The paper presentation highlights the Singapore’s experience and covers the
followings:
a) Legislations pertaining to Strata Development;
b) Basic information that the owners should know on living in strata-titled
properties and the management of their estates.
c) Land Surveyor’s role in the construction and selling of Strata
Development;
d) Functions of the Management Corporation

ABSTRAK
The purpose of the presentation is to highlight some of the challenges confronting strata titled properties and the lessons that have been learned in other jurisdictions, particularly Australia. The Australian experience offers unique insights due to its federal system that creates variations across each of the states allowing comparisons to be drawn. That is, each Australian state has its own strata title regime and therefore we have had the opportunity to analyse the merits of each regime and work toward better implementation.
The presentation will provide an overview of the Australia strata system including some of the key legislative differences across the states. I will then highlight several challenges that have impacted on scheme functionality, viability and liveability and address, not only the lessons that have been learned but also, any steps undertaken to overcome these challenges.
Although the presentation will touch on the challenges of mixed tenure, the impacts that design can have on liveability and issues arising in relation to scheme governance and management, three key areas will be the focus of the presentation including: scheme registration, lot entitlements and liabilities, and sinking funds and forecasting.
Specifically, I will address the legal requirements regarding the registration of the strata scheme and the creation of the body corporate. The various ways of determining lot boundaries and the impacts boundaries have on the management of the scheme. The role of the developer as the scheme promoter and issues arising from that role that impact upon scheme functionality will also be highlighted. I will then address, lot entitlements and liabilities. I will provide an overview of the purpose of entitlements and liabilities and the different ways in which these entitlements and liabilities are expressed in Australian law and in other jurisdictions. An overview of the different calculation methodologies will be summarised and compared.
Finally, I will provide an overview of the various implementations of sinking funds and
the requirements regarding forecasting capital expenditure. I will discuss the
relationship between forecasting capital expenditure and the legal mechanisms
available to fund the expenditure. Further, I will discuss the effectiveness of sinking
funds when schemes are confronted by building defects.

Brunei Institution of Geomatics (B.I.G.)
The Brunei Institution of Geomatics (B.I.G) was formed in 2002 and officially registered under Brunei Societies Act in January 2003. The affairs of the Institution is manage by a council. The council biennially elected in Annual General Meeting. The B.I.G members consist of five classes, namely, Fellows, Professional Members, Associates and Honorary Fellows, technical members; and there shall be classes of Graduate Members, Probationers and Students attached to the Institution. B.I.G membership open to both sexes. Geomatics means “The art, science and technologies related to the management of geographically-referenced information. “Geomatics includes a wide range of activities, from the acquisition and analysis of site-specific spatial data in engineering and development surveys to the application of GIS and remote sensing technologies in environmental management. It includes cadastral surveying, hydrographic surveying, and ocean mapping, and it plays an important role in land administration and land use management.” Objectives of B.I.G.
To promote and advance the science, practice and application of geomatics for the advancement of mankind and community and to foster regional and international cooperation and transfer of technology
To encourage communication between persons charged with the technical responsibility for the planning, design and execution of the practice of geomatics.
To obtain and disseminate among the members, information on geomatics and related matters affecting the profession, and to print, sell, publish, issue and circulate the records of transactions of the Institution or any papers, periodicals, books, circulars and other literacy undertakings or any extracts therefrom as may seem conducive to any of these objects.
To educate and seek to improve, extend and elevate the technical and general knowledge of members and persons concerned with the geomatics.
To serve as a focal point for exchange of ideas related to geomatics.
To conduct, encourage and collate research in geomatics.
To establish, form and maintain in index of available or existing literature and articles on interest in connection with geomatics.
To cooperate, as may seem conducive to any of these objects, with national and international organisations and to support and supplement their work.
To promote the general interests of the profession and to maintain and extend its usefulness for the public advantage.
To conduct professional development programmes by organising training, seminar and conference locally or internationally.
