A recent Kuala Lumpur Construction Court decision decided in favour of a contractor’s claim forloss & expense pursuant to a construction contract based on the PWD/JKR 203/203A Form, wherethe learned Judge had offered a novel interpretation of Clause 44.1 in respect of the need for anotice to claim loss & expense, as well as the use of “recurring preliminaries” as the basis toestimate the value of the loss & expense suffered by the contractor. The speaker will address thehistorical context of how loss & expense clauses are typically interpreted by the courts, andpropose possible alternative strategies for a claim for loss & expense in light of this recent HighCourt decision.
