    MESEJ HARI PEKERJAKita merayakan Hari Mei tahun ini dengan harapan bahawa kita akan membinakesatuan sekerja dan organisasi pekerja yang lebih kukuh untuk menangani isu-isu yang dihadapi oleh pekerja-pekerja di Malaysia. Kami perlumemperkukuhkan gerakan pekerja di Malaysia untuk memperjuangkan hakasasi pekerja di negara ini, sepertimana kita bekerja untuk mengukuhkanpersekutuan kami dengan membina hubungan persaudaraan dengan kesatuansekerja antarabangsa bagi mewujudkan pergerakan kesatuan sekerja globalyang lebih kukuh.

    CABARAN BAGI PEKERJA DI MALAYSIAPekerja di Malaysia telah dilayan dengan tidak adil, terutamanya ketika negaratelah mencapai kemajuan pesat dari segi ekonomi sejak beberapa dekad yanglalu. Perkara yang telah berlaku terhadap pekerja dan pergerakan kesatuansekerja telah pengurangkan pendapatan sebenar memberi ancaman terhadapkeselamatan kerja, penafian hak kesatuan sekerja dan mencetus cabaranberterusan terhadap martabat pekerja.

    Kerajaan masih tidak mengendah dan mengambil kira sentimen rakyatnyaterutamanya golongan pekerja yang berpendapatan rendah. Antara cabaranMTUC ialah:

    Cukai Barangan dan Perkhidmatan (GST) dan Perjanjian PerkongsianTrans-Pasifik (TPPA).

    Elaun Sara Hidup (COLA) sebanyak RM300 kepada semua pekerjadalam sektor swasta.

    Kegagalan Sistem. Gaji dan Peningkatan jurang pendapatan.Hak pemilikan rumah

    BERSATU MTUCSejak kepimpinan baru mengambil alih MTUC pada akhir 2013, Saya gembiradan terharu dengan sokongan yang diberikan kepada kepimpinan MTUC olehahli jawatankuasa kerja, Majlis Am, kesatuan gabungan dan semua ahlikesatuan sekerja di negara ini. Kita perlu bersatu untuk menegakkan hak asasikaum pekerja di negara ini. Terdapat banyak yang boleh dilakukan dan banyakakan dilakukan di mana kita memilih untuk bersatu dan mengambil kedudukanyang kuat untuk memperjuangkan hak-hak pekerja di negara ini.Saya menyeru kepada semua pemimpin-pemimpin muda di sini untukmemainkan peranan yang lebih penting dalam kesatuan sekerja kerana ahlikesatuan sekerja muda ini membawa harapan besar untuk Malaysia yang lebihbaik.Hidup Pekerja !     Sambutan Hari Pekerja 2014Sambutan Hari Pekerja 2014 telah diadakansecara jayanya di Dataran Petaling Jaya AmCorpMall pada 1hb Mei 2014 dibawah pimpinan SdraY.B Abdullah Sani Bin Abdul Hamid TimbalanPresiden MTUC Merangkap Pengerusi MajlisSambutan Hari Mei 2014. Majlis turut dihadiri olehYAB Tan Sri Dato' Seri Abdul Khalid Ibrahim Men-teri Besar Selangor dan Y. Bhg. Puan Dr. HalimahBte Ali-EXCO Jawatan Kuasa TetapPembangunan Modal Insan Kerajaan NegeriSelangor. Menteri Besar telah menjanjikan

    sebidang tanahkepada MTUC bagimembina pusatlatihan kepadapekerja-pekerjanya.

    Dalam ucapannyaPresiden Mohd Kha-lid Atan menegas-kan pendirian MTUCyang tidak me-nyokong GST dan

    juga TPPA. Katanyahasil penelitian secara makro mendapati TPPA ternyataakan memberi kesan negatif kepada ekonomi negara.TPPA sudah diteliti oleh pelbagai pakar ekonomi darikalangan penyelidik serta NGO yang jelas mendapati iaakan berakhir dengan kerugian yang akan ditanggungoleh usahawan tempatan serta membebankan kualitihidup yang akan ditanggung oleh rakyat kese-luruhannya.Dalam masa yang sama disebabkan gejalakenaikan kos yang begitu mendadak MTUC menuntutsupaya pihak kerajaan mengubal satu dasar supaya

    kesemua majikan-majikan di negara ini membayar colaatau elaun sara hidup sebanyak RM300 kepada semuapekerja-pekerja sektor swasta bagi menampung kenai-kan sara hidup dan kos barangan .

    MALAYSI A EPF: 278 Com panyDirectors Prevented from

    Leaving The Countr yThe Employees Provident Fund (EPF) said that 278names of defaulting company directors have beensubmitted to the Immigration Department in the firstquarter of this year to prevent them from leaving thecountry without first settling their employees' EPF con-tribution arrears as provided under Section 39 of theEPF Act 1991.

    In the same quarter, 157 errant employerswere fined a total of RM218,650 by the courts underSection 43(2) of the EPF Act 1991.

    A total of 251 civil suits and 775 criminal cas-es were also filed with the courts against the companydirectors and employers who defaulted on their em-ployees' monthly EPF contributions."The EPF reminds all employers to uphold their re-sponsibility and submit their employees' monthly EPFcontributions timely and accurately as these are theiremployees' hard-earned money for their retirement,"

    EPF General Manager for Corporate Communications,Nik Affendi Jaafar, said in a statement.He said employers must be aware that failure to remitthe monthly contributions on behalf of their employeeswas a serious offence. "The EPF stands firm in safe-guarding our members' retirement savings and will nothesitate to take stiffer action against errant employers,including levying their moveable properties or filingcivil suits against the company directors," he said.

    Under the Act, it is mandatory for employers tosubmit their statutory monthly contributions on behalf

    of their employees before or on every 15th of themonth.

    Among the defaulting employers were Kimpack Plastic

    Industries of Perak, which was fined RM5,000 by thecourt and RM4,000 on Syac Enterprise of the KualaLumpur Federal Territory. Four companies from Selan-gor -- Jurukur Putra and Grand March Sdn Bhd werefined RM3,800 each, while Intergate Digital SolutionsSdn Bhd and Caidmark Sdn Bhd were fined RM3,500and RM2,500, respectively.

    EPF said the court usually allows employerswho were fined to settle their contribution arrears byinstalments of up to six months, which the EPF willcredit all outstanding contributions to the respectivemembers' accounts after the arrears have been recov-ered in full. The EPF encourages employers to submittheir EPF contribution details via e-Caruman, an onlinefacility available via i-Akaun at myEPF website(www.kwsp.gov.my). This online facility allows employ-ers to perform their monthly EPF commitment in a fast-er and more convenient way."While the EPF is committed to protecting members'interests and retirement well-being, they are advised toperiodically check their statements to ensure that theirEPF contributions are in order," Nik Affendi said, add-ing that with the recently launched EPF i-Akaun mobileapp, members can now access their EPF savings onthe move.

    If members find any discrepancy in their EPFaccount, they are urged to immediately check withtheir employer or report it to the EPF. Reports on er-rant employers can be made personally at EPFbranches or by contacting the EPF Call Centre at 03-8922 6000 from 8 am to 6 pm from Monday to Friday.Bernama, 5th May 2014 Kuala Lumpur

    KWSP Isytihar Dividen 6.35% Untuk 2013Pendapatan Kasar Catat Rekod RM35 BilionLembaga Kumpulan Wang Simpanan Pekerja(KWSP) dengan kelulusan Menteri Kewangan, mengisyti-harkan kadar dividen 6.35 peratus untuk tahun kewanganberakhir 31 Disember 2013, bayaran dividen paling tinggisebanyak RM31.20 bilion kepada ahlinya, meningkat 13.66peratus daripada RM27.45 bilion pada 2012.

    Dalam satu kenyataan yang dikeluarkan, Pengeru-si KWSP Tan Sri Samsudin Osman berkata, Denganstrategi pelaburan berhemah dan mantap, prestasi KWSPadalah konsisten dan stabil, terutamanya untuk lima tahunyang lepas. Sejak tahun-tahun kebelakangan ini, KWSP

    telah mempelbagaikan portfolio dengan memperluaskanskop aset pelaburan bagi mengu-ruskan risiko pasaran dan menja-na pulangan yang konsisten.

    Sejak krisis kewanganglobal 2008, KWSP telah men-gisytiharkan dividen dikompaunmelebihi RM120 bilion kepadaahlinya.     PIKET -Pekerja KeretapiTanah Melayu

    Walaupun hujan lebat dan dentuman guruh, kira-kira 700anggota Kesatuan Pekerja-Pekerja Keretapi Tanah Mela-yu Berhad (KPPKTMB) tidak berganjak dari bangunanKeretapi Tanah Melayu Berhad (KTMB) berhimpun untukmendesak Datuk Elias Kadir melepaskan jawatan se-bagai presiden KTMB. Manakala Presiden kesatuanKPPKTMB Abdul Razak Md Hassan yang mengetuaikumpulan itu mendakwa Elias Kadir tidak menunjukkanprestasi yang cemerlang sepanjang perkhidmatan beliauselama dua tahun ini. "Demonstrasi hari ini menyam-paikan rasa tak puas hati dengan Datuk Elias Kadir yang

    telah menjawat jawatan presiden selama 2 tahun, beliautidak melaksanakan tugas dengan berkesan. "Kami kece-wa kerana dia tak mampu cetuskan idea," katanya ketikaperhimpunan itu.

    Abdul Razak berkata pihaknya merancang untukmengadakan satu lagi perhimpunan di KementerianKewangan di Putrajaya. Demonstrasi ini bermula jam 5petang apabila semua penyokong dari sepuluh cawangankesatuan seluruh negeri berhimpun di Hotel Heritagesebelum berarak ke depan bangunan KTMB - berdeka-tan Masjid Negara.     MTUC Bhg Selangor & W.Persekutuan telah menga-dakan program bagi mempromosikan Hari Pekerjasedunai 2014 yang berlansung pada 1 Mei di Petal-ing Jaya. MTUC Bhg Sel & W.P mengambil pendeka-tan berkonvoi dan mengedarkan risalah-risalahberkenaan Hari Pekerja kepada orang awam diseki-tar Shah Alam dan Kuala Lumpur.

    Sebanyak 46 buah kereta dikumpul di data-ran Shah Alam seawal 8.00 pagi bagi menyertainyakonvoi ini. Majlis ini telah dirasmikan oleh EXCO Ke-

    rajaan Negeri Selangor YB Ir Iskandar b Abd SamadPegawai-pegawai tertinggi MTUC turut bersama .Ucapan telah disampaikan oleh Pengerusi HariPekerja Sdra Abdullah Sani, Setiausaha AgungMTUC Sdra Gopal krishnam dan matan pengerusiMTUC senator Syed Shahir.

    Pada pagi itu juga Belia MTUC telahmelancarkan lagu baru untuk MTUC yang bertajukSOLIDARITI MTUC ciptaan senator turut di-perdengarkan buat pertama kalinya. Pelepasan pe-serta konvoi telah dilakukan oleh Pengerusi HariPekerja 2014 Sdra Abdullah Sani bersama senatorSyed Shahir. Jumlah peserta adalah seramai 200orang.

    Malaysia joins the list of countries deemed the worst places in

    the world to work in as it does not guarantee workers' rights,according to a survey by the International Trade Union Con-federation (ITUC).

    In its first-ever Global Rights Index report, compiledfrom 97 indicators, Malaysia scored 5, joining Cambodia,Bangladesh, China and Nigeria and 19 other countries.

    A 1 is given to the best countries and 5 for the worst.Countries with the rating of 5 are the worst coun-

    tries in the world to work in. While the legislation may spellout certain rights, workers have effectively no access to theserights and are, therefore, exposed to autocratic regimes andunfair labour practices, said the report released in Berlin.

    As of 2012, there is an estimated 12.9 million peo-

    ple in the workforce in Malaysia. An estimated 6.44% aremembers of trade unions, of whom about 53% are privatesector workers, 38% public sector workers, and 9% workersof statutory bodies or local authorities.

    A recent example of alleged violation of workers'rights involved national carrier Malaysia Airlines. MAS tookdisciplinary action against Mohd Akram Osman, secretary-general of the National Union of Flight Attendants Malaysia(Nufam), and 30 other Nufam members for an illegal gather-ing.

    The move was criticised by many, including civilsociety, and other trade unions. They called on MAS to rec-ognise and respect workers rights, including the freedom ofassociation and the right to join a union. Meanwhile, 18 coun-tries, including Denmark, Norway and Uruguay, scored a 1.

    "Collective labour rights are generally guaranteed.Workers can freely associate and defend their rights collec-tively with the government and/or companies and can im-prove their working conditions through collective bargaining.Violations against workers are not absent but do not occur ona regular basis," it said about the 18 countries.

    The survey covers violations in 139 countries rec-orded between April 2013 and March 2014. NeighbouringSingapore scored a 3, meaning that its government and com-panies regularly interfered in collective labour rights andfailed to guarantee important aspects of these rights. Amongthe key findings in the ITUC report were governments of atleast 35 countries have arrested or imprisoned workers as atactic to resist demands for democratic rights, decent wages,safer working conditions and secure jobs.

    In at least nine countries, murder and disappear-ance of workers were commonly used to intimidate workers.Eight countries, including Somalia, South Sudan, Palestineand Ukraine, with the most severe violation of workers' rightswere given a 5+ score which effectively means that therewas no guarantee of rights because of the breakdown of therule of law.

    "Workers in countries with the rating 5+ have equal-ly limited rights as workers with the rating 5. However, incountries with the rating 5+, this is linked to dysfunctionalinstitutions as a result of internal conflict and/or military occu-pation. In such cases, countries are assigned the rating 5+,"ITUC said. May 23, 2014.

    19th International Commemora-tion Day for the Dead and Injured

    Workers, 28th April 2014

    Hari memperingati kematian dan kemalangan pekerjadi tempat kerja telah diadakan pada 28hb April 2014 diibu Pejabat MTUC. Di hadiri lebih kurang 80 pemimpinkesatuan dari pelbagai sektor telah dikendalikan olehJawatan kuasa Keselamatan dan Kesihatan MTUCdi bawah pimpinan Sdra Matkar Siwang. Majlis ini te-lah dirasmikan oleh Mohd Khalid Atan, PresidenMTUC.

    Antara tajuk utama yang dibentangkan ialahkewajipan undang-undang dan tanggungjawab moral

    majikan bagi mengurangkan kemalangan berkaitankerja di tempat kerja dan melindungi pekerja-pekerjamelalui undang-undang, peraturan dan perlaksanaanyang kukuh dan penglibatan kesatuan.

    Pekerja-pekerja Federal Power Sdn Bhd dibawahnaungan Kesatuan Pekerja Elektik (EIWU) telah men-gadakan piket diperkarangan syarikat pada 21-22 Meidan seterusnya piket ke-2 pada 28-29 Mei 2014.

    Piket ini adalah hasil dari kegagalan syarikatmengiktiraf Perjanjian Bersama yang ke-10 disamping ugutan untuk keluar dari menyertai kesatuanKebangsaan EIWU dan tidak membenarkan pemo-tongan yuran kesatuan serta tidak bayar kenaikantahunan.
