ETHAN KWAN Fax : 03-3325 1023 Dear Sir, HAULIER DRIVERS’ DISPUTE OVER CONTAINER DEPOT GATE CHARGE IN PORT KLANG We hereby refer to the recent protest by haulier drivers over the payment of depot gate charge at container depots in Port Klang. 2. The protest had far reaching effects on the deliveries and receipt of containers at both Northport and Westport resulting in massive disruption to import and export boxes.

3. Last Friday, following a joint announcement by MOT, MITI, LPK, AMH and Container Depots to resolve the matter, the drivers agreed to call off the protest and returned to work. The solution worked out by AMH and depot operators refers to individual agreements to be signed by each haulier company with depot operators which will enable depots to receive DGC payment by credit or other terms so that payment of cash by drivers is avoided completely. 4. As of 7 May 2012, LPK have been advised that all on-dock depots and 15 off- dock depots have agreed to the proposal while AMH is meeting the remaining 7 off- dock depots today to seek an agreement. 5. Given that shipping lines are the principal clients and users of the depots, we seek your utmost co-operation in leveraging on your advantageous position to urge the depot operators to participate in the initiative and assist in resolving the issue. 6. LPK realises that a reasonable period of time is required for haulier companies to formalise individual agreements with each depot operator. However our immediate objective is for the depot operators to cease collecting cash DGC payments from the haulier drivers, failure which the drivers have threatened to embark on a fresh strike on Wednesday 9 May 2012. 7. The matter has been brought to the attention of the Prime Minister, the Minister of Transport and the Minister of International Trade and Industry who have expressed their grave concern on the matter and its impact on the port industry and the nation’s trade and economic well-being. Following this, the Minister of Transport has authorised LPK to take all necessary actions to ensure that port operations and cargo delivery and receipt is not jeopardised. 8. After exhausting all avenues, LPK hereby directs that, as an interim measure, shipping lines, shipping agents and NVOCCs shall pay DGC charges of RM 10.00 (Ringgit Malaysia ten only) directly to the depot operators for boxes picked up or dropped off by the hauliers at their nominated depots. This arrangement shall be maintained for a period of 1 month effective 9 May 2012. During this period, the AMH initiated arrangement will be formalised between Depots and Haulier Companies or if necessary other alternative arrangements may be pursued. 9. We appeal to all shipping lines, shipping agents and NVOCCs to cooperate with LPK in the interest of preventing further disruptions to the cargo delivery system and port operations. During this interim period, LPK will engage all relevant parties from the government, industry and private sector to ensure that the issue is resolved once and for all.
