(KAWALAN PELEPASAN DARIPADA MOTOSIKAL) 201X
PADA menjalankan kuasa yang diberikan oleh seksyen 21, 22, 45 dan 51 Akta Kualiti Alam
Sekeliling 1974 [Akta 127], Menteri, selepas berunding dengan Majlis Kualiti Alam
Sekeliling, membuat peraturan-peraturan yang berikut:
BAHAGIAN I
PERMULAAN
Nama dan permulaan kuat kuasa
1. (1) Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan Kualiti
Alam Sekeliling (Kawalan Pelepasan Daripada Motosikal) 201X.
(2) Peraturan-Peraturan ini hendaklah mula berkuat kuasa pada XXXXXXX kecuali
subperturan 5(2).
Tafsiran
2. Dalam Peraturan-Peraturan ini, melainkan jika konteksnya menghendaki makna
yang lain-
“berat tanpa muatan” mempunyai erti yang sama sebagaimana ditafsirkan di bawah
Akta Pengangkutan Jalan 1987 [Akta 333];
“Chassis Dynamometer Smoke Test” ertinya suatu ujian yang dijalankan untuk
mengukur pelepasan gas pencemar dan menganalisis kecekapan pembakaran bahanbakar
daripada motosikal secara simulasi di bawah pelbagai keadaan pemanduan sebagaimana
yang dinyatakan dalam UN Regulation No.40;
“gas pencemar” ertinya gas daripada ekzos motosikal yang mengandungi Karbon
Monoksida (CO), Oksida Nitrogen (NOX) yang dinyatakan dalam Nitrogen Dioksida (NO2)
yang setara atau Hidrokarbon (HC);
“jalan" mempunyai erti yang sama yang diberikan kepadanya di bawah Akta
Pengangkutan Jalan 1987 [Akta 333];
“jenis kenderaan” ertinya kategori atau kumpulan kenderaan motor yang tidak
berbeza dari segi persamaan inersia mengikut berat rujukan, enjin dan ciri-ciri kenderaan
seperti yang dimaksudkan dalam UN Regulation No. 40;
"Kemudahan Yang Diluluskan" ertinya suatu kemudahan atau tempat yang
diluluskan oleh Ketua Pengarah di bawah subperaturan 16(1);
“meter gas” ertinya suatu peranti atau alat yang diperakukan oleh Ketua Pengarah
untuk mengukur pelepasan gas pencemar daripada motosikal yang dipasang dengan enjin
petrol;
“model baru” ertinya model motosikal yang berbeza daripada model sebelumnya
yang dihasilkan oleh pengeluar, rekabentuk asal, pembinaan kenderaan, chasis, janakuasa,
jenis badan, perubahan spesifikasi enjin atau berat motosikal seperti yang dimaksudkan
dalam UN Regulation No. 40;
“motosikal” ertinya kenderaan motor yang mempunyai kurang daripada empat roda
dan yang berat tanpa muatannya tidak melebihi empat ratus lima puluh kilogram;
“On Board Diagnosis” ertinya satu sistem diagnosis untuk mengawal pelepasan
yang mempunyai kebolehan mengenalpasti bahagian yang berkemungkinan tidak
berfungsi melalui kod-kod kesilapan yang tersimpan di dalam memori komputer;
“orang berwibawa” ertinya orang yang diperakukan oleh Ketua Pengarah
sebagai orang yang berwibawa di bawah seksyen 49A Akta;
“pegawai diberi kuasa” ertinya mana-mana pegawai yang dilantik di bawah seksyen
3 Akta atau mana-mana pegawai lain yang kepadanya Ketua Pengarah telah mewakilkan
kuasanya di bawah seksyen 49 Akta bagi maksud Peraturan-Peraturan ini;
“pemasang” ertinya mana-mana orang, firma atau perbadanan yang
bertanggungjawab terhadap motosikal yang dipasang atau dibina semula bagi membentuk
satu unit yang sedia untuk beroperasi;
“pengeluar” ertinya mana-mana orang, firma atau perbadanan yang
bertanggungjawab terhadap motosikal yang direka bentuk, dipasang atau dibina bagi
membentuk satu unit yang bersedia untuk beroperasi;
“pengendali” ertinya mana-mana orang, termasuk pemunya atau penduduk premis
atau kemudahan yang mempunyai kawalan atas Kemudahan Yang Diluluskan;
“pengimport” ertinya syarikat, firma atau persatuan atau mana-mana pertubuhan
atau orang yang mengimport motosikal atau enjin motosikal masuk ke Malaysia;
“ujian melahu” ertinya ujian bagi pelepasan gas daripada motosikal dengan
penghantaran dilepaskan dalam gear neutral apabila enjinnya diuji;
“UN ECE” ertinya Pertubuhan Bangsa-Bangsa Bersatu bagi Suruhanjaya Ekonomi
Eropah;
“UN Regulation No.40 “ ertinya peraturan-peraturan yang dikeluarkan oleh
Pertubuhan Bangsa-Bangsa Bersatu bagi Suruhanjaya Ekonomi Eropah berhubung dengan
pelepasan gas pencemar bagi motosikal yang dipasang dengan enjin nyalaan positif,
termasuk pindaan-pindaan yang berkaitan dengannya; dan
“wakil rasmi” ertinya mana-mana wakil yang diberi kuasa secara bertulis oleh
pemasang atau pengimport atau pengeluar.
Pemakaian
3 (1) Peraturan-Peraturan ini hendaklah terpakai bagi motosikal yang berdaftar di
bawah Seksyen 7(1) Akta Pengangkutan Jalan 1987 [Akta 333].
(2) Peruntukan Peraturan-Peraturan ini tidak terpakai bagi
(a) motosikal digunakan untuk tujuan perlumbaan dalam litar lumba yang
ditetapkan atau dalam acara perlumbaan yang diluluskan; dan
(b) motosikal mempunyai kelajuan reka bentuk maksimum 50km/jam atau
kurang.
BAHAGIAN II
KELULUSAN JENIS KENDERAAN BAGI MODEL BARU MOTOSIKAL
Pemakaian Bahagian II
4. Bahagian ini hendaklah terpakai bagi setiap model baru motosikal yang kali pertama
akan digunakan di Malaysia sama ada:
(a) motosikal baru yang dikeluarkan atau dipasang di Malaysia atau diimport ke
Malaysia; atau
(b) motosikal terpakai yang dipasang di Malaysia atau diimport ke Malaysia .
Had pelepasan gas pencemar bagi model baru motosikal
5. (1) Semua model baru motosikal hendaklah mematuhi had pelepasan gas pencemar
seperti yang ditetapkan dalam Jadual Pertama.
(2) Pada atau selepas 1 Januari 2019, semua model baru motosikal hendaklah
mematuhi had pelepasan gas pencemar seperti yang ditetapkan dalam Jadual Kedua;
Pengesahan had pelepasan gas pencemar
6. (1) Bagi maksud mengesahkan had pelepasan gas pencemar di bawah Peraturan-
Peraturan ini, Ketua Pengarah boleh menghendaki mana-mana pengeluar, pemasang,
pengimport atau wakil rasmi untuk menjalankan ujian kelulusan jenis kenderaan yang
ditentukan oleh Ketua Pengarah di hadapan pegawai diberi kuasa dengan kos ditanggung
oleh pengeluar, pemasang, pengimport atau wakil rasmi itu.
(2) Mana-mana pengeluar, pemasang, pengimport atau wakil rasmi yang gagal
mematuhi subperaturan (1) adalah melakukan satu kesalahan di bawah peraturan ini.
(3) Ketua Pengarah boleh menerima mana-mana model baru motosikal yang
mematuhi had pelepasan dan prosedur ujian yang Ketua Pengarah berpendapat setara atau
lebih ketat lagi daripada prosedur dan spesifikasi yang dinyatakan di dalam peraturan ini.
Pemasangan “On Board Diagnosis”
7. Ketua Pengarah atau mana-mana pegawai diberi kuasa boleh mengarahkan kepada
pengeluar, pemasang, pengimport atau wakil rasmi untuk pemasangan “On Board
Diagnosis” ke atas setiap model baru motosikal dengan mengeluarkan satu notis bertulis.
Ujian kelulusan jenis kenderaan
8. (1) Bagi maksud Peraturan 5, ujian kelulusan jenis kenderaan bagi suatu model baru
motosikal hendaklah mematuhi ujian berikut-
a) Jenis I: Mengesahkan purata pelepasan gas pencemar di kawasan bandar
sesak;
b) Jenis II: Pelepasan Karbon Monoksida pada keadaan melahu; dan
c) Jenis VIII : Ujian pengesahan alam sekitar “On Board Diagnosis”.
(2) Ujian jenis I, II dan VIII yang dirujuk di bawah subperaturan (1) adalah
berdasarkan kepada prosedur ujian kelulusan jenis kenderaan yang ditetapkan di dalam
UN Regulation No. 40 yang hendaklah dilakukan di makmal atau di kemudahan ujian yang
memenuhi akreditasi ISO/IEC 17025 atau yang diiktiraf oleh pihak berkuasa kelulusan
jenis UN ECE .
(3) Bagi maksud subperaturan (2), Ketua Pengarah atau mana-mana pegawai diberi
kuasa boleh menghendaki mana-mana pengeluar, pemasang, pengimport atau wakil rasmi
untuk menjalankan ujian kelulusan jenis kenderaan yang pada pendapat Ketua Pengarah
perlu dijalankan di hadapan pegawai diberi kuasa dengan kos ditanggung oleh pengeluar,
pemasang, pengimport atau wakil rasmi itu.
(4) Pengeluar, pemasang, pengimport atau wakil rasmi hendaklah mengemukakan
laporan ujian kelulusan jenis kenderaan kepada Ketua Pengarah bersama maklumat
berkaitan seperti yang ditetapkan oleh Ketua Pengarah.
(5) Ketua Pengarah atau mana-mana pegawai diberi kuasa boleh mengeluarkan
perakuan kelulusan jenis kenderaan ke atas motosikal tersebut selepas berpuas hati
bahawa laporan ujian kelulusan jenis kenderaan yang dikemukakan mematuhi had yang
ditetapkan dalam Jadual Pertama atau Jadual Kedua mengikut mana-mana yang berkaitan.
Pengubahsuaian terhadap motosikal
9. (1) Mana-mana pengeluar, pemasang, pengimport atau wakil rasmi yang
mengubahsuai motosikalnya hendaklah mengemukakan laporan ujian kelulusan jenis
kenderaan seperti yang ditetapkan di bawah peraturan 8 dan perlu mematuhi had
pelepasan gas pencemar yang ditetapkan dalam Jadual Pertama atau Jadual Kedua
mengikut mana-mana yang berkaitan.
(2) Ketua Pengarah atau mana-mana pegawai diberi kuasa boleh mengeluarkan
perakuan kelulusan jenis kenderaan ke atas motosikal tersebut selepas berpuas hati
bahawa laporan ujian kelulusan jenis kenderaan yang dikemukakan mematuhi had yang
ditetapkan dalam Jadual Pertama atau Jadual Kedua mengikut mana-mana yang berkaitan.
Pengesahan dalam pengeluaran
10. (1) Bagi tujuan pengesahan dalam pengeluaran untuk siri pengeluaran model
motosikal yang diluluskan di bawah subperaturan 8(5) atau 9(2), pengeluar, pemasang,
pengimport atau wakil rasmi hendaklah mengambil sampel mengikut cara yang ditetapkan
oleh Ketua Pengarah dan memastikan sampel mematuhi had pelepasan yang ditetapkan
dalam Jadual Pertama atau Jadual Kedua mengikut mana-mana yang berkaitan.
(2) Bagi maksud subperaturan (1), pengeluar, pemasang, pengimport atau wakil
rasmi perlu menyediakan laporan pengesahan dalam pengeluaran bagi ujian pelepasan gas
pencemar dan mengemukakannya kepada Ketua Pengarah.
Perakuan oleh pengeluar, pemasang atau pengimport
11. Pengeluar, pemasang atau pengimport hendaklah sebelum penghantarserahan
motosikal kepada pemunya, mengeluarkan perakuan mengikut cara yang ditetapkan oleh
Ketua Pengarah yang menyatakan bahawa motosikal itu telah diperiksa, diuji dan
dilaraskan dan memenuhi kehendak-kehendak peraturan ini.
BAHAGIAN III
KAWALAN PELEPASAN PENCEMARAN DARIPADA MOTOSIKAL
Pemakaian Bahagian III
12. Bahagian ini hendaklah terpakai bagi setiap motosikal tanpa mengira sama ada ia
sedang digunakan atau tidak bergerak, di mana-mana jalan, premis atau Kemudahan Yang
Diluluskan.
Had pelepasan gas pencemar yang dibenarkan
13. Tiada motosikal dibenarkan melepaskan gas pencemar melebihi had yang
ditetapkan dalam Jadual Ketiga.
Ujian pelepasan gas pencemar
14. (1) Ketua Pengarah atau mana-mana pegawai yang diberi kuasa boleh dengan
notis arahan secara bertulis menghendaki mana-mana orang atau pemunya atau
pengendali motosikal yang melanggar atau disyaki melanggar peraturan 13, untuk
menjalankan ujian pelepasan gas pencemar motosikal di Kemudahan Yang Diluluskan atau
di mana-mana tempat yang diarahkan oleh Ketua Pengarah atau mana-mana pegawai yang
diberi kuasa atas perbelanjaan sendiri.
(2) Ketua Pengarah atau mana-mana pegawai diberi kuasa boleh memasuki dan
memeriksa motosikal untuk menjalankan suatu ujian pelepasan gas pencemar di bawah
seksyen 48A Akta di Kemudahan Yang Diluluskan atau mana-mana jalan atau premis.
(3) Mana-mana orang yang tidak patuh notis arahan di bawah subperaturan (1)
adalah melakukan satu kesalahan di bawah peraturan ini.
(4) Ujian pelepasan gas pencemar untuk motosikal hendaklah dikendalikan
dalam keadaan enjin melahu dengan menggunakan meter gas.
(5) Ketua Pengarah atau mana-mana pegawai diberi kuasa boleh mengarahkan
mana-mana orang atau pemunya atau pengendali motosikal untuk mengendalikan ujian
pelepasan gas pencemar dengan cara ujian bebanan dengan menggunakan “Chassis
Dynamometer Smoke Test”.
(6) Keputusan ujian pelepasan gas pencemar bagi peraturan ini adalah seperti
yang dicetak oleh meter gas atau apa-apa cara atau kaedah lain yang ditentukan oleh Ketua
Pengarah.
Enjin hendaklah dimatikan
15. Tiada seorang pun boleh membenarkan enjin mana-mana motosikal dihidupkan
semasa motosikal itu tidak bergerak selama lebih tiga minit di dalam kawasan tertutup
atau kawasan awam atau kawasan letak kereta separa tertutup atau mana-mana
perhentian.
BAHAGIAN IV
KETETAPAN LAIN
Kemudahan Yang Diluluskan
16. (1) Ketua Pengarah atau mana-mana pegawai diberi kuasa boleh melantik, atau
dengan permohonan, meluluskan mana-mana kemudahan yang dilengkapi meter gas dan
mempunyai orang berwibawa sebagai Kemudahan Yang Diluluskan untuk menjalankan
ujian dan mengenalpasti had pelepasan gas pencemar secara melahu atau ujian bebanan
dengan menggunakan “Chassis Dynamometer Smoke Test”.
(2) Bagi maksud subperaturan (1), Ketua Pengarah atau mana-mana pegawai
diberi kuasa boleh menetapkan syarat-syarat kelulusan kepada pengendali Kemudahan
Yang Diluluskan. Kelulusan ini hendak digantung sepanjang ketidakpatuhan syarat-syarat
yang ditetapkan sehingga Ketua Pengarah atau mana-mana pegawai diberi kuasa berpuas
hati dengan bukti-bukti pematuhan yang dikemukakan oleh pengendali.
Penyimpanan Rekod
17. (1) Bagi maksud subperaturan 16(1), suatu rekod mengandungi nombor
pendaftaran motosikal, tarikh, masa dan keputusan apa-apa ujian pelepasan gas pencemar
yang dilakukan hendaklah disimpan oleh pengendali Kemudahan Yang Diluluskan.
(2) Rekod hendaklah tersedia untuk diperiksa oleh Ketua Pengarah atau mana-
mana pegawai diberi kuasa.
(3) Pengendali Kemudahan Yang Diluluskan hendaklah menyimpan rekod-rekod
ujian yang dijalankan sekurang-kurangnya selama tiga tahun daripada tarikh ujian
motosikal.
BAHAGIAN V
KESALAHAN
Kesalahan yang boleh dikompaun
18. (1) Kesalahan-kesalahan di bawah Peraturan 6, 7, 8, 9, 10, 11, 13, 14, 15, 16 dan
17 adalah kesalahan yang boleh dikompaun.
(2) Pengkompaunan apa-apa kesalahan di bawah Peraturan-Peraturan ini
hendaklah mengikut prosedur yang ditetapkan dalam Kaedah-Kaedah Kualiti Alam
Sekeliling (Mengkompaun Kesalahan-Kesalahan) 1978 [P.U. (A) 281/78] dipinda oleh [P. U.
(A) 512/1999].
Penalti
19. Mana-mana orang yang melanggar atau gagal mematuhi Peraturan-Peraturan ini
kecuali kesalahan di bawah peraturan 5 dan 13 adalah melakukan suatu kesalahan dan
boleh, apabila disabitkan, didenda tidak melebihi satu ratus ribu ringgit atau penjara
selama suatu tempoh tidak melebihi dua tahun atau kedua-duanya.
Pembatalan
20. (1) Peraturan-Peraturan Kualiti Alam Sekeliling (Kawalan Pelepasan Daripada
Motosikal) 2003 [P.U.(A) 464/2003] adalah dibatalkan (selepas ini disebut sebagai
“Peraturan-Peraturan yang dibatalkan”) selepas tarikh permulaan kuat kuasa Peraturan-
Peraturan ini.
(2) Apa-apa prosiding, sama ada sivil atau jenayah, yang dimulakan di bawah
Peraturan-Peraturan yang dibatalkan dan belum selesai pada tarikh permulaan kuat kuasa
Peraturan-Peraturan ini hendaklah, pada tarikh permulaan kuat kuasa Peraturan-
Peraturan ini, diteruskan dan diselesaikan di bawah Peraturan-Peraturan yang dibatalkan
dan bagi maksud itu hendaklah disifatkan seolah-olah Peraturan-Peraturan ini tidak
dibuat.

(CONTROL OF EMISSION FROM MOTORCYCLES) REGULATIONS 201X
IN exercise of the powers conferred by section 21, 22, 45 and 51 of the Environmental
Quality Act 1974 [Act 127], the Minister, after consultation with the Environmental Quality
Council, makes the following regulations:
PART I
PRELIMINARY
Citation and commencement
1. (1) These regulations may be cited as the Environmental Quality (Control of
Emission From Motorcycles) Regulations 201X.
(2) These Regulations shall come into operation on XXXXXXXXXX except
subregulation 5(2).
Interpretation
2. In these Regulations, unless the context otherwise requires -
“unladen weight” have the same meaning as assigned in the Road Transport Act
1987 [Act 333];
“Chassis Dynamometer Smoke Test” means a test used to measure gaseous emissions
and analyze the efficiency of fuel combustion from motorcycles simulated under various driving
conditions as stated in the UN Regulation No.40;
“gaseous pollutant” means the exhaust gaseous from motorcycle that contain of
Carbon Monoxide (CO), Oxides of Nitrogen (NOX) expressed in Nitrogen Dioxide (NO2)
equivalent or Hydrocarbons (HC);
“road" has the same meaning assigned to it under the Road Transport Act 1987 [Act
333];
“vehicle type" means a category or group of motor vehicles which do not differ from
the terms of reference equations by weight of inertia, the engine and vehicle characteristics
as defined by the UN Regulation No. 40.
"Approved Facility" means a facility or place approved by the Director General
under subregulation 16(1);
"gas meter" means a device or tool that is recommended by the Director General to
measure gaseous emissions from motorcycles fitted with petrol engine;
“new model" means a motorcycle model that is different from previous models
produced by the manufacturers, original design, vehicle construction, chassis, power, body
type, engine specification changes or heavy laden vehicle as defined by the UN Regulation
No. 40
"motorcycle" means a motor vehicle with less than four wheels and an unladen weight not
exceeding four hundred fifty kilogram;
“On board diagnosis” means diagnostic system for emission control which has the
capability of identifying the likely area of malfunction by means of fault codes stored in
computer memory;
“competent person” means a person has been certified by the Director General as a
competent person under section 49A Act;
“authorized officer” means any officer appointed under section 3 of the Act or any
other officer to whom the Director General has delegated his power under section 49 of the
Act for the purpose of these Regulations;
“assembler" means a person, firm or corporation who is responsible for the
motorcycle assembled or reassembled to form a unit that is ready to operate;
“manufacturer" means any person, firm or corporation who is responsible for the
motorcycle designed to form, assemble or build a unit that is ready to operate;
“operator" means any person, including the owner or occupier of the premises or
facilities who has control over the Approved Facility;
“importer" means the company, firm or association or any other organization or
person importing motorcycles or motorcycle’s engines into Malaysia;
“Idle test" means a test for gas emissions from motorcycle with transmission
discharged in neutral gear when the engine is tested;
UN ECE” means the United Nations Economic Commission for Europe;
“UN Regulation No.40 “ means the regulations issued by the United Nations Economic
Commission for Europe in relation to gaseous emissions for motorcycles fitted with positive-
ignition engines, including the related amendments; and
"official representative" means any authorized representative of the manufacturer
or importer or assembler.
Application
3. (1) These Regulations shall apply to motorcycles as registered under section
7(1) the Road Transport Act 1987 [ Act 333 ].
(2) The provisions of Regulations shall not apply to-
(a) motorcycles used for racing purposes in designated racing circuits or in
approved racing events; and
(b) motorcycles having maximum design speed of 50km/hour or less.
PART II
VEHICLE TYPE APPROVAL FOR NEW MODELS OF MOTORCYCLE
Application of Part II
4. This section shall apply to all new models of motorcycle which was first used in
Malaysia whether it is :
( a ) new motorcycle produced or assembled in Malaysia or imported into Malaysia;
or
( b ) used motorcycles assembled in Malaysia or imported into Malaysia.
Emission limits for new models of motorcycle
5. (1) All new models of motorcycle issued shall comply with emission limits as
prescribed in the First Schedule.
( 2 ) On or after January 1st, 2019 , all new models of motorcycle shall comply with
the emission limits as prescribed in the Second Schedule.
Conformity of emission limits
6. (1) For the purpose of verifying the gaseous emission limits under this regulation,
the Director General may require any manufacturer, assembler, importer or an official
representative to carry out vehicle type approval test specified by the Director General in
the presence of an authorized officer of the cost borne by the manufacturer, assembler,
importer or an official representative.
(2) Any manufacturer, assembler, importer or an official representative who
contravenes or fails to comply with subregulation (1) shall be guilty an offense under this
regulation.
(3) The Director General may accept any new model of motorcycles that comply
with the emission limits and test procedures as he considers to be equivalent or more
stringent than the procedures and specifications set out in this regulation.
On Board Diagnosis installation
7. The Director General or any authorized officer may direct the manufacturer,
assembler, importer or authorized representative for installation of On Board Diagnosis on
each new model motorcycle by issuing a written notice.
Vehicle type approval tests
8. (1) For the purposes of Regulation 5, any new model of motorcycles shall comply
with the following vehicle type approval tests:
a) Type I : verifying the average emission of gaseous pollutants in a
congested urban area;
b) Type II : Carbon Monoxide emission at idling speed;
c) Type VIII : On Board Diognostics environmental verification test
(2) Type I, II and VIII as referred to under subregulation (1) are based on the
vehicle type approval test procedures as specified in the UN Regulation No. 40 to be done in
the laboratory or testing facility that meets the accreditation of ISO/ IEC 17025 or
recognised by UN ECE Type Approval Autohiries.
(3) For the purposes of subregulation (2) the Director General or any authorized
officer may require any manufacturer, assembler, importer or official representative of the
importer to carry out vehicle type approval test in the opinion of the Director General
should be conducted, in the presence of an authorized officer of the cost borne by the
manufacturer or assembler or importer or an official representative.
(4) Manufacturer, assembler, importer or official representative shall submit the
vehicle type approval test report together with relevant information as may be specified by
the Director General.
(5) The Director General or any authorized officer may issue a certificate of vehicle
type approval on the motorcycle after test reports submitted satisfactory and complies
with the emission limits specified in the First or Second Schedule to any relevant.
Modifications to the new model of the motorcycle
9. (1) Any manufacturer, assembler, importer or official representative that modify
their motorcycles shall submit the vehicle type approval test reports as prescribed under
regulation 8 and shall comply with the emission limits as specified in the First or Second
Schedule to any relevant.
(2) The Director General or any authorized officer may issue a certificate of vehicle
type approval on the motorcycle after test reports submitted satisfactory and complies
with the limits specified in the First or Second Schedule to any relevant.
Conformity of production
10. (1) For conformity of production purposes in series production model of motorcycle
approved under subregulation 8(5) or 9(2), the manufacturer, assembler, importer or
official representative should take sample as prescribed by the Director General and ensure
it was comply with the emission limits set out in the First or Second Schedule to any
relevant.
(2) For the purposes of subregulation (1) , the manufacturer, assembler , importer
or authorized representative must provide conformity of production report of gaseous
emission test and submit to the Director General.
Certification by manufacturer, assembler or importer
11. The manufacturer, assembler or importer, prior to the delivery of new motorcycle to
the owner, shall issue a certificate as prescribed by the Director General stated that the
motorcycle has been correctly inspected, tested and adjusted correctly and meet the
requirements under this regulations.
PART III
EMISSION CONTROL FOR IN-USE MOTORCYCLE
Application of Part III
12. This part shall apply to all motorcycle, regardless of whether it is used or not
moving on any road, premise or Approved Facility.
Allowable emission limits of gaseous pollutant
13. (1) No motorcycle shall discharge gaseous pollutant in excess of the emission limits
as specified in the Third Schedule.
(2) Notwithstanding subregulation (1), the Director General may in a particular
case if it considers necessary, with respect to gaseous pollutant emission limits in any
period, impose a more stringent limits than the limits specified in the Third Schedule.
Gaseous pollutant emission test
14. (1) The Director General or any authorized officer may by notice in writing require
any person or the owner or operator of motorcycle contravenes or suspected contravenes
of regulation 13 , to conduct a gaseous pollutant emission test of motorcycle in Approved
Facility or any place as directed by the Director General or any authorized officer of the
cost borne by the owner or operator of the motorcycle.
(2)The Director General or any authorised officer may enter and inspect the
motorcycle to carry out gaseous pollutant emissions test under section 48A of the Act in
Approved Facility or any road or premis.
(3) Any person who contravenes or fails to comply the notices under subregulation
(1) shall be guilty an offense under this regulation.
(4) Gaseous pollutant emission test for motorcycle shall be operate in the idle
engine using gas meter according to User Manual issued by the gas meter manufacturer.
(5) The Director General or any authorized officer may orders any person or the
owner or operator of motorcycle to be conducted gaseous pollutant emission test with the
load test method by using the Chassis Dynamometer Smoke Test.
(6) The test result of gaseous pollutant emission for this regulation is as printed
by the gas meter or other method determined by the Director General.
Engine should be turned off
15. (1) No person shall allow any motorcycle engine to run when the motorcycle is
stationary for more than three minutes in an enclosed or a partially enclosed public place
or parking area or any terminus.
PART IV
MISCELLANEOUS PROVISIONS
Approved Facility
16. (1) The Director General or any authorised officer may appoint, or with
application, to approve any facility equipped with gas meter and competent person to be
an Approved Facility to test and identify gaseous pollutant emission limits in idling or load
test method by using the Chassis Dynamometer Smoke Test.
(1) Approval under sub-regulation (1) The Director General or any authorised
officer may set approve conditions for the operator of the Approved Facility. The approval
shall be suspended throughout the non-compliance with the conditions of the approval
until the Director General or any authorised officer satisfactory with the compliance that
can be proven by the operator.
Record Keeping
17. (1) For the purposes of regulation 16(1), a record containing the motorcycle
registration number, date, time and results of any gaseous pollutant emission test
conducted shall be kept by the Approved Facility operator.
(2) The records shall be available for inspection by the Director General or any
authorized officer.
(3) Approved Facility operator shall keep the test records at least three years from
the testing date of the motorcycle.
PART V
OFFENCES
Compoundable offences
18. (1) The offences under the Regulations 6, 7, 8, 9, 10, 11,13, 14, 15, 16 and 17 may be
compounded.
(2) The compounding of any offence under these regulation shall be accordance
with the procedure prescribed in the Environmental Quality (Compounding of Offences)
Rules 1978 [P.U. (A) 281/78] amended by [P. U. (A) 512/1999].
Penalty
19. Any person who contravenes or fails to comply with any provisions of there
Regulations except regulation 5 and 13 shall be guilty of an offence and shall, on conviction,
be liable to a fine not exceeding one hundred thousand ringgit or to imprisonment for a
term not exceeding two years or to both.
Revocation
20. (1) The Environmental Quality (Control of Emission from Motorcycles) 2003
[P.U.(A) 464/2003] are revoked (hereinafter referred to as “ the revoked Regulations”)
after the date of the coming into operation of these regulations.
(2) Any proceeding, whether civil or criminal, commenced under the revoked
Regulations and are pending on the date of the coming into operation of these Regulations
shall, on the coming into operation of these regulations, be continued and concluded under
the revoked regulations and for such purposes it shall be treated as if there regulations had
not been made.
