The President welcomed all members to the November 2004 members meeting. 1. MEMBERSHIP

b) Luxor Beauty World Sdn Bhd Importer of cosmetics brand Algotherm, stagecolor make-up and Dayenne

c) Crabtree & Evelyn (Malaysia) Sdn Bhd Importer and Retailer for products under Crabtree & Evelyn brand.

d) CNI Ventures Sdn Bhd Manufacturer of house brand RJ.

Since the members do not have any concern and queries, the members have approved the membership and they will be invited to attend the members meeting in January 2005.

2. MEETING WITH MINISTER OF HEALTH

The Minister of Health Dr Chua Soi Lek called for a meeting with the Cosmetic Industry. The meeting was held at the Minster of Health's office in Kuala Lumpur on 9th November 2004. FMM-Mctig, MDDA, DSAM, Persatuan Kosmetik Bumiputra Malaysia and CTFA attended the meeting. The Board/TRC members represented CTFA at the meeting. (Attached the related matters, which were brought up by the industry, CTFA's proposal and the Minister/BPFK's comments). The President requests all members to clear their correspondence tray from the registration form and do not wait until the last minutes to reply to all the outstanding correspondence.

3. TECHNICAL WORKING GROUP(TWG) MEETING The TWG meeting was held on 21 October 2004. The following issues were discussed:- a) BPFK advised members to cc a copy of all online issues send to TIR to

Encik Jaffar of BPFK ([email protected]) and if possible also to CTFA secretariat office.

b) Import License - Quest 1 to Quest 2 Migration

All products to be registered as new products and no migration will be done.

c) EU-Asean Harmonization Technical Representative

The following members were selected as technical team by BPFK and they will be trained by EU and in return train the local industry. i) Puan Hamidah - PMS/PSE (1) Lab Assessment ii) Mr How Kam Chiong & Ms Lau Lay Hong - PMS/PSE (2) Product

Safety and Efficacy Evaluation iii) En Zulhaimi - PMS/PSE (3) Managemnet of Adverse Events iv) Loh Weng Leong - Scientific Body

d) Existing Products under registration i) Submitted paid not reviewed 3400 ii) All submissions should be cleared by October 2004 iii) Current aging period 24 days

e) Problems at point of entry

Relabelling allowed after import but Product Name and batch Number must be on products at time of entry.

f) Import of cosmetic in bulk and repack in Malaysia If product contents are exposed during repackaging, it is considered as local manufacturing and will require GMP.

g) BPFK will not be giving any exemption for registration products for seasonal promotion packs.

4. PHARMACEUTICAL ON-LINE REGISTRATION The President, TRC Chairman and Zulhaimi attended the meeting. During the meeting a lot was discussed on the problems with the online system, most of the problems were similar with the Cosmetic online registration. Companies, who have pharmaceutical products, Phase 1 and 2, have to migrate to the system to the Quest 2 system. BPFK have given an extension for migration until June 2005.

5. HOLOGRAM The following 9 associations who are lobbying against mandatory hologram stickering on registered products has ended the work on hologram end October 2004. Certain Pharmaceutical Associations is preparing to be in compliance with the hologram implementation. PhAMa - Pharmaceutical Association of Malaysia MOPI - Malaysian Organization of Pharmaceutical Industry MDDA - Malaysian Direct Distribution Association DSAM - Direct Selling Association of Malaysia FMM-MCTIG - Federation of Malaysian Manufacturers -

Malaysian Cosmetics & Toiletries Industry Group MSCT - Malaysian Society from complementary Therapies FCPMDAM - Federation of Chinese Physician & Medicine Dealers Association of Malaysia PURBATAMA - Persatuan Pengeluar-Pengeluar Ubat-Ubat Tradisional Melayu Malaysia CTFA - The Cosmetic, Toiletry & Fragrance Association of Malaysia The President would like to put in record En Zulhaimi's work on hologram.

6. SIRIM CTFA have been approached by SIRIM to send 2 representative to sit on the Technical Committee on Halal Food and Islamic Consumer Goods. The President has nominated Vice President, En Abdul Aziz and En Muhammad Sharif of P T Mustika Ratu.

7. ENFORCEMENT CTFA organised a meeting with Dr Ahmad of Enforcement on 6 November 2004. Some of the problems with enforcement and entry points were brought up:-

a) Import licence certified true copy - Dr. Ahmad agreed that certified true copy will only be needed for the copy of import licence. Copies of product lists do not need to be certified.

b) In-market label compliance for existing (submitted before 1st Feb 2004) products - Dr. Ahmad agreed that enforcement will be delayed until 1st June 2005

c) Imports of existing (submitted before 1st Feb 2004) products - Dr. Ahmad agreed that payment voucher can continue to be used until 1st June 2005

d) Imports of new variants where the mother product is either registered or existing - Dr. Ahmad will inform enforcement to allow use of payment voucher for product clearance.

Members were reminded to be ethical in their import practices. No mixing of registered and unregistered products in shipments. Enforcement will not stop checking details until they are confident that our imports are clean. Vice President, Encik Abdul Aziz advised members to be aware of enforcement officers who are going around checking on products. Members who have such problems to send an e-mail to the secretariat office.

8. MARKET INTELLIGENCE The ringgit peg has once again become a HOT ISSUE as speculators bet that a decision to either repeg to reflect a fairer value or move to a more flexible regime has to be made soon. Reasons for the speculation :- Weakening of the US$ which has plunged to a 9 yr. low against the euro at US$l.30 and Y104 against the yen. China's decision to cut its benchmark one-year lending rate on Oct 30th. A devaluation of the yuan will have a negative impact on the region's exports if Asian economies do not adjust their exchange rates to that of China. China's currency currently pegged at 8.3 yuan to US$1 for past 10 years. Hwang-DBS thinks a revaluation of the ringgit will be positive for the economy: A weak ringgit penalises the domestic sector because an undervalued currency artificially raises import bills. A stronger ringgit is beneficial to the government's fiscal position - its debt burden, which is about 70% US-dollar denominated, will be immediately reduced. A stronger ringgit will help contain inflation. A shift to a more flexible currency regime is positive for the capital markets - it should be seen as part of a broader game plan for greater financial market liberalisation. Maintenance of the peg can be costly in view of inflows of hot money. In Malaysia Nor Mohamed has said early this year that a review would only be triggered if the ringgit moves 20% or more against regional currencies (base year l998) and even then, it would have to stay around those levels for a while before the govt. will review the peg. Malaysian retailers are expected to see a rise in holiday spending this year as improved consumer sentiment coincides with the festive shopping season. The Malaysian Institute of Economic Research (MIER) said in a recent publication - strong economic growth, the higher number of tourist arrivals (over 1 million per month), the stock market rebound and bonus payments for civil servants are the factors that will contribute to positive consumer sentiment in the last quarter of the year. January to June's growth was 10% and it is expected to close the year at 7.1%

8. Market Intelligence (con't) In the prestige cosmetics in department stores, the growth for 10 months has shown high double digit growth of +30% for C. Dior, Lancome, Biotherm, SK11, and Shu Uemura; + 20% for Shiseido and +10% for Estee Lauder, CLinique, Chanel, Clarins and Aramis. The Master Index of Retail forecast, by credit card giant MasterCard International, expects the Asia Pacific Region to continue its robust performance in retail sales growth in second half 2004. Expectation of stronger income growth and better employment conditions clearly have more than compensated for higher interest rate expectations which is a good sign for retailers and the service sector. Outsourcing is the latest buzzword among corporations in Malaysia these days. Malaysia ranked an unexpected 3rd position globally - behind India and China in the latest Offshore Location Attractiveness Index 2004 by AT Kearney Offshore Index. Malaysia, with only a population of 25 million is unable to compete against these countries scale advantages - however our government's active role in promoting the information technology and service sectors

will keep us among the top favorite for outsourcing and shared services. Low infrastructure costs, the most attractive business climate among emerging markets, and competitive levels of global integration are reasons cited for Malaysia's spot in the index. Our PM mentioned shared services and outsourcing is now one of the largest sector in Malaysia's Multimedia Super Corridor, a hightech industrial zone, having investments of +RM1 billion by 49 companies and creating some 8,000 jobs. By 2010 they expect at least 100,000 new jobs. Outsourcing of processes, such as manufacturing and call centres to countries with a lower cost of operations, are a common trend among multinationals. The shared services business model is for common services like IT processes and marketing that are based in one country to leverage on economies of scale.

9. ANNUAL DINNER

The annual held on 17 September at Eastin Hotel was a success and the association made a surplus of RM5038. For members who have not paid for their annual dinner to do so before end of the year. The National Cancer Society thanks CTFA for the contributions collected on that night, contribution collected total RM1241. CTFA also send a cheque for RM1000.00 to top up our contribution for the night.
