MARRIAGE APPLICATION THROUGH THE COURT

Based on the current Islamic family law enforced in all state of Malaysia, the application for permission to marry should be applied through The Registrars of Muslim Marriage, Divorces, and Ruju’, at the place where the women resides.

However, there are certain applications whereby the Registrar of Marriage shall refer the matters to the Syariah Judge in order to obtain permission to marry. The cases among others are as follows:

i. Application by a man who is under the age of eighteen (18) and/ or by a woman who is under 16 years old.

ii. Application by a divorcee that is a woman who has been married and divorced before consummation of marriage.

iii. Application of marriage being solemnized by Wali Hakim in cases as follows:

1. Where the woman has no wali from nasab (descent based on lawful blood relationship)

2. The wali is unknown (wali ghaib)

3. Muallaf

4. Illegitimate children

5. Refusal of the Wali to solemnize the marriage

6. The wali is in the state of ihram while performing hajj/umrah

7. The wali cannot be reached due to reason of darurat (critical situation)

iv. Application for polygamy

Application to contract polygamous marriage shall be submitted to the Syariah Subordinate Court where the applicant resides. The required documents to be attached with the application are as follows:

a) Application

b) Affidavitinsupport

c) Exhibits(copyofidentitycard,thecertificateofembracingIslam, marriage form for women and men, and other related documents)

d) Support letter from the Registrar of Marriage

e) Payment of the required fee

f) Wakalah of the Syarie Lawyer for those who is represent-ed by a Syarie lawyer
