MBAM also had the opportunity to host and organise one of the biggest international events which was the 44 th International Federation of Asian and Western Pacific Contractors’ Associations (IFAWPCA) Convention which took place from 12 th to 16 th November 2018. Numerous seminars, trainings, fellowship gatherings and outreach programmes were organised as part of our continuous development and we look forward to organise more exciting and interesting events in 2019. The tournament kicked-off at 9.15am with 8 groups and top 2 from each group proceeded to the knock-out stage before the teams continued with quarter-final and semi-final. The tournament was more intense in the final round as the teams were competing for the Champion title. At MBAM, we hope all the teams had an enjoyable and fun filled session at the tournament celebrating the spirit of sportsmanship. In the last month of the year, I am thankful for all the support that MBAM members andSecretariat staffs have given as well as all the hard work contributed throughout the year. In ourbusy year of growth and change, highlights of 2018 included the 64th Annual General Meetingon 23rd June 2018 which we have elected new council members for the term 2018-2020and the swearing in ceremony on 6th July 2018. The fifth series of MBAM Futsal Tournament 2018 took place on 1st December at Samba de Futsal,Petaling Jaya. The tournament served as one of the platforms to unite members through sportsactivities with 24 competing teams of 209 players from MBAM Ordinary Members and MBAMAffiliate Members.

MBAM Council Member and MBAM FutsalTournament 2018 Organising Chairman,Dato’ Alex Wee Cheng Kwan in his openingspeech thanked the sponsor, API-MDC Groupof Companies (API-MDC) for their supportand believing in MBAM’s activities. Dato’Alex also presented a token of appreciationto the representative from API-MDC, MrDaniel.

The tournament kicked-off at 9.15am with 8groups and top 2 from each group proceededto the knock-out stage before the teamscontinued with quarter-final and semi-final. The tournament was more intense in the finalround as the teams were competing for the Champion title.

MBAM and Construction Industry Development Board (CIDB) Malaysia together with the Johor Master Builders Association(JMBA) jointly organised a 2-day seminar on Occupational Safety & Health (OSH) and Workshop on Construction AccidentInvestigation on 3rd and 4th December 2018 at Holiday Villa Johor Bahru, Johor. The seminar was supported by the SocialSecurity Organisation (SOCSO), and was endorsed by National Council for Occupation Safety & Health (NCOSH) andDepartment of Occupational Safety & Health (DOSH).

It was aimed to enhance the standard of safety and health atconstruction work sites by creating awareness among employersand construction site personnel on the importance of practicinghigh standard of occupational safety management at constructionsites.

The seminar started with a presentation on “Guidelines onOccupational Safety and Health in Construction Industry(Management) – OSHCIM 2017” by Senior Chief Assistant Director,

DOSH Johor, Tuan Haji Zulkifly Bin Sulaiman. The paper emphasisedon key aspect of the fundamental to future construction legislation thatwill be a catalyst for improving industry's poor OSH performance andpolicy shift to self-regulated, cooperation, performance based approachand responsibilities of each stakeholder.

For the Opening Ceremony, we were honoured to have the Director ofDOSH Johor, Ir. Hj. Dasuki bin Mohd Heak to officiate the event, witnessedby MBAM President, Mr Foo Chek Lee, who was accompanied by MBAMCouncil Member and Chairman of MBAM Safety & Health Committee,Mr Michael Yap Kok Wai and President of JMBA, Ir. Tee See Kim.

The session continued with the presentation of Paper 2 on “Complyingwith Culture of Care to the Chief Inspector’s Special Order to ProjectManager on Operations and Safe Management of Tower Crane” by Chief

Executive Officer (CEO) of Master Team Resources Sdn Bhd, Mr Abdullah Embong. The paper further elaborated on safety aspriority for creating a Culture of Care, based on behavioural perspective. He also emphasised on leadership criteria that opt for aculture beyond procedure and documentation.

MBAM Council Member and Vice President of MalaysiaMobile Crane Owners Association (MMCOA), Mr Alec ChongSun Park also delivered a paper on “Challenges Faced byCrane Operators”. He shared on the topic of risk, types ofcranes, challenges of crane operator, hazard and commonaccident involving cranes and competency training whichuphold and embrace safety and health culture throughoutcrane operations as a commitment.

Another important topic was on “SOCSO Roles in Protectingthe Welfare of Workers” and it was presented by SOCSOJohor representative, Puan Zafirah Binti Arifin.

Corporate Management Director of Satujaya Sdn Bhd, MrMichael Yap highlighted OSH best practices in his paper“Sharing of OSH Best Practices in Construction – SHASSIC inIKEA”. The last presenter for Day 1 was Senior EmploymentEnhancement Officer of SOCSO Kuala Lumpur, MrAndreas Charles Akobiarek who accentuated on SOCSO’sEmployment Services.

Day 2 of Workshop on Construction Accident Investigationwas facilitated by the former DOSH Malaysia Director ofForensic EngineeringDivision, Ir. AbdulAziz Bin Yahya. Thepurpose was toprovide participantswith the basicskills and knowledgenecessary to conductan effective accidentinvestigation in thework place.

The two full days seminar was beneficial and essential for all constructionsafety personnel who are responsible for occupational safety and health.

BOARD OF ENGINEERS (BEM) OPEN DAY 2018 IN CONJUNCTIONWITH HARI PROFESION TEKNIKAL NEGARA

MBAM was invited to attend the inaugural BEM Open Day 2018 on4th December 2018 at Dewan Tan Sri Mahfoz Khalid, Kuala Lumpur. Theevent was attended by MBAM Deputy President, Tan Sri Sufri Hj. MohdZin; MBAM Vice President, Mr Steven Shee Boo Cheong; MBAM CouncilMember, Mr Lau Yew Mun and MBAM PR Executive, Ms Chew Chee Yan.

The Opening Session in the morning was welcomed by the Director-General of Public Works Department and President of BEM Malaysia, Dato’Sri Ir. Dr. Roslan bin Md Taha. In his speech, he shared that at the Cabinetmeeting on 3rd October 2018, the Cabinet agreed to declare the NationalTechnical Profession Day on the first Saturday of December each year tocommemorate the establishment of the Malaysian Public Works Department(Jabatan Kerja Raya, JKR) on 3rd December 1872.

The two-day program was officiated by Minister of Works, Tuan BaruBian. Tuan Baru also presented the Award for JKR Technical Figure Year2018 to Tan Sri Ir. Dr. Jamilus bin Hussein who is the President for KLIAGroup of Companies. This newly introduced annual recognition is held torecognise the services and contributions of the technical profession tothe country, and is dedicated to individuals who are still or who haveserved JKR.

The above event was held on 4th December 2018 at Wisma REHDA. MBAM Contracts and Practices Committee Member, Ms ChuAi Li participated on behalf of MBAM at the Forum. Other MBAM representatives in attendance were MBAM Contracts and PracticesMembers, Mr Khoo Cheong and Mr Lee Chee Yian and MBAM Assistant General Manager, Mr Lenny Lim.

The construction industry has been an important contributor to the Malaysian economy. However, late payment or non-paymentremain chronic issues that affect the entire delivery chain of construction industry. To counter this issue, Construction Industry

Payment and Adjudication Act (CIPAA) was gazetted by the Government inJune 2012 and it came into force two years thereafter with the objectives tofacilitate regular and timely payment, to provide a mechanism for speedydispute resolution through adjudication, and to provide remedies for therecovery of payment for parties affected in the construction industry.

In a recent report published by Asian International Arbitration Centre (AIAC),there has been a significant increase in adjudication matters over the past 4years after CIPAA was introduced. Based on the latest statistics, a total of 711adjudication matters were reported in the calendar year 2017, up from 463 inthe year 2016.

The above event was held on 4th December 2018 at AIAC, Bangunan Sultan Sulaiman, Kuala Lumpur. MBAM Vice President andChairman of MBAM Contracts and Practices Committee, Mr Oliver Wee; MBAM Honorary Advisor (Education), Mr Chua Siow Lengand MBAM Assistant General Manager, Mr Lenny Lim attended the event.

Mr Oliver Wee also participated in “Tracing a Construction Claim” forum as the make-believecontractor from Out Of Pocket Sdn. Bhd. “Tracing a Construction Claim” was intended togive insight into the various facets of a claim, as viewed by the key players in the journeyfrom the occurrence of a claim event to the outcome of an arbitration award and itssubsequent challenge, with attempts at mediation and adjudication in between.

The event was an excellent opportunity for everyone involved in constructions disputes togain an insight into every aspect of the journey from the inception of a claim through tofinality. Attendees were meant to see the dispute from different eyes namely contractor,lawyer, arbitral institute, adjudicator, mediator, arbitrator and judge to learn what it takesto get a better result.

After the event, Lighthouse Club KL held a networking and drinks session at thePavilion also at AIAC, Bangunan Sultan Sulaiman.

LIGHTHOUSE CLUB KUALA LUMPUR: TRACING A CONSTRUCTION CLAIM

Ms Chu shared on the dilemma of the contractors on the realities after the enaction of CIPAA. CIPAA was supposed to provide aquick solution to cash flows but in reality, many of the cases actually end up in court and have in fact caused more cost to contractorsin terms of legal fees spent. Ms Chu also spoke on other initiatives such as mediation which MBAM is also pursuing as an alternative.

COURTESY VISIT BY LE TRIANGLE, FRANCERepresentatives of Le Triangle visited MBAM on 6th December 2018. The meeting was arranged by the Trade Commission ofthe French Embassy in Malaysia and Le Triangle was represented by Mr Loic Gault and Mr Romain Gauthier. They were metby MBAM Deputy President cum MBAM International Affairs Chairman, Tan Sri Sufri Hj. Mohd Zin and MBAM Vice President,Mr Dennis Tan. Also present at the meeting were MBAMAssistant General Manager, Mr Michael Thong, MBAMManager Mr Mohd Farhan Mohammad Din and MBAMAssistant Manager, Ms Lim Jong Joan.

Le Triangle main activity is the construction of livestockbuilding on a turnkey basis and has strong presence in regionsuch as Europe and Oceania. It has also embarked onproduction of solar panel. It buys steel coils frommanufacturers in Europe and fabricate the coils to clients’requirements.

MEETING WITH REPRESENTATIVES OF MALAYSIA PRODUCTIVITYCORPORATION (MPC): APPEAL ON MACHINERY IMPORT DUTIES

MBAM met with representatives of Malaysia Productivity Corporation (MPC) and PEMANDU on 6th December 2018 at TanSri Datuk Tee Hock Seng’s Conference Room. Attending on behalf of MBAM were MBAM Chairman of MachineryResources Committee, Mr Ong Ka Thiam,MBAM Machinery Resources CommitteeMember, Mr Alec Chong, MBAM ExecutiveDirector, Ms Loh Mei Ling and MBAM AssistantGeneral Manager, Mr Lenny Lim.

Attending on behalf of MPC and PEMANDUAssociates were Manager of MPC, Ms NorHalisa Mohamad Halil, Assitant Manager,MPC, Mr Abdul Rahman Kamis, Senior VicePresident of PEMANDU Associates, Mr WoodyAng, Manager, PEMANDU Associates, MsDiana Taty binti Md Azman and Associate,PEMANDU Associates, Ms Andrea Lau.

MPC together with PEMANDU Associates arein the midst of coming up with initiatives forthe Machinery & Equipment sector for theyears 2019-2020, with the aim of improvinglabour productivity.

They have formed working groups which consist of industry players to drive these initiatives. 2 of the initiatives are on:1. Improvement to SST regime; and2. Streamlining of import duties to encourage in-country value-add activities

The purpose of their visit is to explore opportunities to work with local fabricators to form strategic alliance to promote theirexpertise and services around this region. They considered that it is not feasible for them to purchase steel coils from Europe forthis region projects as their pricing will not be competitive. They also explored the opportunity to use local produced productssuch as hot dip galvanized coil, colour bond materials etc. MBAM has advised them to familiarise themselves with Malaysiaregulatory and standard requirements.

PRE-SEMINAR INTERVIEW REQUEST FROM ACCENTURE JAPAN FOR UPCOMINGSEMINAR & BUSINESS MATCHING IN JAPANESE INFRASTRUCTURE

TECHNOLOGIES IN FEBRUARY 2019Mr Lo Siang of Accenture Japan visited MBAM for a pre-seminar interview with MBAM President, Mr Foo Chek Lee on12th December 2018 with the aim to conduct market research with various organisations such as MBAM on its preferred seminartopics of the industry and simultaneously to comprehend the industry needs other than to gain an insight into the professionalsin Malaysia. According to Mr Lo, the upcoming seminar is targeted to be held in February 2019. During the interview session,MBAM Manager, Mr Mohd Farhan Mohammed Din and MBAM Assistant Manager, Ms Lim Jong Joan were in attendance.

Mr Lo informed that Accenture Japan was appointedby the Ministry of Land, Infrastructure, Transport andTourism (MLIT) of Japan to organise a seminar onJapanese technologies as well as business matching withJapanese companies. The purpose of the seminar isalso to facilitate the exchanges and strengthening ofrelationship between infrastructure industry in Japanand Malaysia. MLIT will lead over 10 leading Japanesecorporations that will present their latest technologiesfor the construction industry, in particular, theinfrastructure.

INAUGURAL SYMPOSIUM OF SUSTAINABLE AND SMART BUILT ENVIRONMENTMBAM Council Members, Datuk Astaman Abdul Aziz and Mr Lau Yew Mun and MBAM Senior Manager, Ms Lee Siew Mei attendedthe Faculty of Built Environment, Tunku Abdul Rahman University College (TAR UC)’s “Inaugural Symposium of Sustainableand Smart Built Environment” held on 12th December 2018.The purpose of the symposium was to provide a platform forknowledge exchange and sharing among participants from theindustry and academia on the latest trend and developmentrelated to the theme of symposium. Overall, the symposium wasinformative.

Highlights of the symposium were key note addresses by DeputyDirector of Malaysia Productivity Corporation (MPC), Dr. ShaikRoslinah Bux and Managing Director of Hitachi Asia (Malaysia)Sdn Bhd, Mr Chew Huat Seng. The symposium also featuredpresentations from nine speakers from the industry andinstitutions of higher learning:-

1. Ms Lim Hui Yan (Gamuda IBS) – Digital IBS – The Game Changer2. Dr John Orr (University of Cambridge, UK) – Knitting Bespoke Reinforcement for New Concrete Structures3. Ir. Edward Han (BIM Engineering Solution and Technology Sdn Bhd) – Bridging the Information Gap in Build Environment4. Assoc. Prof. Dr. Ng Swee Ching (TAR UC) – Government-Industry-Academic Tripartite Effort for Smart and Green Building

Talent Development5. Dato’ Chan Wah Kiang (Ajiya Berhad) – Innovative Sustainable IBS Smart Building Solutions6. Mr Yang JingWen (Giant Leap Construction Sdn Bhd) – Intelligent Prefabricated Construction System in Malaysia7. Prof. Dr. Hamzah Abdul Rahman (Wawasan Group of Companies) – Construction 4.0 – Zero Defect via Digitalisation8. Sr. Dr. Khairul Nizam Tahar (UiTM) – The Role of Drone in Smart Built Environment9. The proponent of adopting new construction or digital technologies is not high in Malaysia. Mr Foo advised that the seminarcould encompass the construction technologies such as IBS on its applications for projects, how technologies minimise accidentsat sites and its effectiveness in carrying out projects efficiently. Other than technologies, introduction of new construction material,an advancement in boring or coring equipment for rails infrastructure will also be good topics to explore on. The other areas tocover could be on technologies that can minimise reliance on foreign workers, water treatment or smart city.

Mr Lo cited some examples of new technologies used in Japan. Some companies are using iOT where it can monitor pilingprogress while others are using drone at construction sites. As for material, in Japan, the Japanese companies prefer to use steelto construct bridges instead of concrete.

Mr Foo proposed to Accenture Japan to co-host with MBAM and he introduced MBAM exhibition arm, MBAM Onebuild whoseexhibition caters solely for the construction industry. Mr Foo also relayed to Mr Lo on the recent exhibition that was held inconjunction with 44th IFAWPCA Convention in November 2018 where there was a high turnout from tradesmen. Mr Lo theninformed that he will bring this proposal to his team and the said Ministry.

MBAM together with the Construction Industry Development Board (CIDB)Wilayah Persekutuan Kuala Lumpur (WPKL) jointly organised a seminarprogramme on CIDB Act 520 Standard and Compliance on 13th December2018 at CIDB Wilayah, Wisma FGV, Kuala Lumpur.

The seminar was officiated by MBAM Vice President, Mr Steven Sheeaccompanied by Managers of CIDB WPKL, Mr Mohd Nor and Mr Nur AfiqNor Azidin, and MBAM Manager, Mr Mohd Farhan Mohammad Din.

A total of 40 participants attended the programme which featuredpresentations by panel speakers from CIDB Headquarter on the followingtopics:

The Embassy of the Republic of Indonesia in Kuala Lumpur, Malaysia in collaboration with the Indonesia Investment CoordinatingBoard (BKPM) held a half day business forum on 14th December 2018 at Le Salon, Grand Hyatt Kuala Lumpur. The forum wasattended by MBAM Vice President, Mr Dennis Tan, MBAM Alternate Council Member, Mr Shafidz Iswandi Azhar, MBAM PastDeputy President, Dato’ Aziz Bahaman, Head of Group Strategy from MMC Corporation Berhad, Mr Badrulhisyam Fauzi andMBAM Assistant Manager, Ms Lim Jong Joan.

This business forum was to provide an ideal platform for Malaysian investors to gain first-hand knowledge on the latest investmentpolicies, procedures and opportunities in Indonesia especially in Special Economic Zones (SEZ) and Industrial Parks (IP) as well asto explore collaborative opportunities with fellow business leaders and government officials.

The Chef of Mission, Mr Krishna Kesuma Utama Hannan gave the opening remarks on behalf of the Ambassador of the Republicof Indonesia to Malaysia H.E. Rusdi Kirana. The Director of Regional Promotion & Facilitation, Indonesia Investment CoordinatingBoard (BKPM), Mr Nurul Ichwan started the forum with a keynote address.

Mr Nurul Ichwan gave an overview of “Indonesia Business Outlook 2019: Investment Climate & Opportunities in Indonesia”.Indonesia is expected to contribute an estimated global growth of 2.5%. It has a 3 ten years plans to reach GDP per capita ofUSD29,934 in year 2045. From 2016 – 2025, it planned to strengthen its economic structure, year 2026-2035 will beacceleration through innovation and the 2036-2045 is concentration on modernisation of quality and sustainability.

To achieve this, it will emphasise on education to meet the demand of skilled workers where there will be a sufficient pool ofcompetent industrial workforce to turn Indonesia into a powerhouse. To generate the competent workforce, among the plans areindustrial vocational education will be introduced similar to Germany’s dual system and establishment of higher education inindustrial zones. It also intends to achieve inclusive growth in the digital age through setting some government priorities such as

Global BIM CoE introduced the proposal of the International BIM Assessmentand Training Framework and the intention to invite CIDB to join into theSteering Committee to support the International Assessment Centre inHong Kong. The committee will be contributing in a research on GapAnalysis between countries in BIM Training and Assessment and also todetermine supplementary competency courses needed to undergo theonline assessment to acquire the international certification. This internationalaccreditation and certification will not affect the local accreditation andcertification.

Currently, the standard for BIM in Malaysia is based on ISO 19650:2018“Organization and digitization of information about buildings and civilengineering works, including building information modelling (BIM) --Information management using building information modelling” and for this

international accreditation and certification, it will depends on discussion, understanding and decision made by the steeringcommittee.

Global BIM CoE is focusing in accrediting and certifyingindividuals and CIDB E-Construct is currently focusingfurther ahead to accredit and certify organisations thatpractice BIM. However, CIDB E-Construct will wait forthe formal invitation which will be presented to CIDBbefore making any decision regarding these matters.

Global BIM CoE also invited MBAM to be one of thesupporting organisations to support BIM InternationalAssessment, Training, Accreditation and Certification aswell as contributing to the development of “GuideBook – BIM Best Practice for Construction”. Nevertheless,MBAM is still waiting for an official invitation beforemaking any decision.

On 18th December 2018, MBAM in collaboration with Deloitte Malaysia organised a talk programme highlighted on 2019 Budget,which attracted 33 participants. The talk was split into two sessions with Session 1 conducted by Deloitte Malaysia Country

Managing Partner cum MBAM Honorary Advisor (Taxation), Mr Yee Wing Peng and Session2 with a panel discussion where Mr Yee was joined by MBAM President, Mr Foo Chek Leeand MBAM Council Member, Ms Tan Zi Ni. I also had the privilege to be present at suchinformative talk programme.

Participants were free to ask questions regarding their confusion especially with thetransition from GST to SST and its impact to businesses with emphasis on the constructionindustry. Participants were also concerned with the outlook of Malaysian constructionindustry in the year ahead. During the panel discussion, both Mr Foo and Ms Tan also tookthe opportunity to advise participants to learn and adapt the way of working from thecontractors in China who focus on the efficiency and completion of projects within time.

2019 BUDGET SEMINAR: HOW WILL 2019 BUDGET IMPACT OUR ECONOMY& CONSTRUCTION INDUSTRY?

Indonesia is poised to become ASEAN’s biggest digital economy. Among the 7succesful starts up, 4 are from Indonesia namely Gojek, Traveloka, Tokopediaand Bukalapak. There are another 44 starts up currently. Fintech transactionis expected to grow from USD22.78 billion to USD32.32 billion in year 2020.

There are 18 industries eligible for tax holiday under the new scheme for thoseindustry that does not fall into the 18 categories. Discussion will be held byrelated ministries and coordinated by BKPM. 145 business fields comes underthe tax allowance. It will take 25 days to process the tax allowance where a5% reduction of corporate net income tax for 6 years. The Government ofRepublic of Indonesia has developed an Online Single Submission System iewww.oss.go.id which is an integrated online sharing of data among thevarious ministries.

Presentations on Java Integrated Industrial and Port Estate (“JIIPE”) and BatamIndonesia Free Trade Zone (“Batam FTZ”) were on an overview of thedevelopment and the progress of the parcels of development and therespective investment incentives. The Head of Business Development and TariffPlanning, Batam FTZ Authority (“BP Batam”) Mr Punomo Andiantono presentedon Batam FTZ while the Head of Tenant relation, Mr Haris Arianto gave hispresentation on JIIPE. A Q & A session was held before a networking lunch.

MBAM was invited to attend a seminar on “Local Sourcing Programme In Malaysia And Business Meeting Session” held at MenaraMATRADE, Kuala Lumpur on 19th December 2018. The seminar was attended by MBAM Assistant Manager Ms Lim Jong Joan.

The objective of the programme was to provide business opportunities for Malaysian companies to penetrate internationalmarkets related to construction projects. The programme comprised of briefing session and one-to-one business meetingsbetween Malaysian companies and selected project owners. The targeted products and services to source from Malaysia includebuilding materials, construction and related services.

Three companies presented the overview of their respective projects and procurement opportunities at the seminar. They areBattersea Power Station Development Company, UK on Battersea Power Station development, YTL Developments, UK on itsdevelopment, Brabazon at Bristol, UK and AlloyMtd Philippines Inc. Phase 1 of the 200-hectare National GovernmentAdministrative Center. Min Cousult gave a brief presentation on global experience. The seminar ended with a Q & A followedby a business matching session.

AND BQ PREPARATION / VALUE MANAGEMENTMBAM Executive Director, Ms Loh Mei Ling welcomed 43 participants to Session No. 8 of Practical Construction ContractAdministration/Management based on 48 BK ENTRUSTY Articles published in Master Builders Journal from 2002 to 2016 on20th December 2018 at MBAM Training Centre. The topic discussed was “Tender/Contract Documents and Obligations”.The speaker for the event, Sr. HT Ong of BK Entrusty alsocovered “Principles of Measurement and BQ Preparation andValue Management”. In general, the contract documents setout the obligations and responsibilities of the parties to thecontract. Normally, on a traditionally-procured, fully-designedconstruction project, the contract documents for suppliers suchas the main contractor are likely to include the following:

1. Article of agreement and conditions of contract, forcompleting as a simple contract (or as a deed)

2. Working drawings3. Bills of quantities4. Specifications5. Schedules of work

Both client and contractor should engross the contract bywitnessed signatures prior to commencement of work. Inpractice, the administrative effort of collating all necessary paperwork can be overtaken by the desire to begin construction. Insuch circumstances, it becomes harder to sort out any disputes as to the content. A tender on the other hand is a submissionmade by a prospective supplier in response to an invitation to tender. It makes an offer for the supply of goods or services. Aninvitation to tender might be issued for a range of contracts, including; equipment supply, the main construction contract (perhapsincluding design by the contractor), demolition, enabling works, etc. Construction contracts are meticulously created so that allthe specifications are clearly defined. It is vital for contractors, owners and designers to carefully consider their obligations.
