I hereby agree and declare that, to the best of my knowledge and belief:

a) Butir-butir dan maklumat yang diberikan oleh saya dalam borang permohonan ini bagi penubuhan Amanah, setelah membuat semua pertanyaan yang munasabah, benar, lengkap dan betul; saya akan memaklumkan as-Salihin Trustee Berhad secara bertulis dengan serta-merta jika apa-apa maklumat yang terkandung dalam permohonan ini tidak tepat atau berubah dalam apa jua keadaan. Saya mengakui dan mengesahkan as-Salihin Trustee Berhad boleh mempercayai semua deklarasi ke atas identiti dan semua maklumat yang berkenaan untuk penubuhan akaun amanah melalui deklarasi.

The particulars and information furnished by me in this application form for the establishment of Trust is, having made all

reasonable enquiries, true, complete and correct; I will advise as-Salihin Trustee Berhad in writing immediately if any information contained in this application ceases to be accurate or changes in any way. I acknowledge and confirm that as-Salihin Trustee Berhad shall be entitled to rely on my declaration above on the identity (ies) and also all information relating to the setting up of the trust account.

b) Saya bersetuju untuk memaklumkan as-Salihin Trustee Berhad semua perubahan ke atas kediaman saya dan/atau kewarganegaraan dan/atau Benefisiari dan mana-mana pihak yang berkaitan Amanah.

I agree to inform as-Salihin Trustee Berhad of all changes in my residence and/or citizenship and/or that of the Beneficiaries and

any relevant parties to the Trust.

c) Saya mengesahkan apa-apa wang dan/atau lain-lain asset yang dipindahkan sekarang atau pada bila-bila pada masa akan datang ke dalam Amanah atau mana-mana syarikat adalah milik saya atau akan menjadi milik saya.

I confirm that any monies and/or other assets transferred now or at any time in the future to the Trust or any underlying company

are or will be my property (ies).

d) Saya mengesahkan bahawa apa-apa wang dan/atau aset lain di dalam Amanah oleh Setlor adalah bebas daripada apa-apa tanggungjawab, caj atau bebanan.

I confirm that any monies and/or other assets to be settled in the Trust by the Settlor are free from any lien, charges or

encumbrances.

e) Saya mengesahkan bahawa saya tidak bankrap dan tidak ada prosiding untuk pengisytiharan saya bankrap. I confirm that I am not an undischarged bankrupt and there are currently no pending proceedings for bankruptcy.

f) Saya faham bahawa dengan memindahkan wang dan/atau lain-lain aset ke dalam Tabung Amanah, saya memindahkan pemilikan wang dan/atau aset lain kepada sesiapa yang dilantik sebagai Pemegang Amanah untuk manfaat benefisiari.

I understand that by settling the monies and/or other assets into the Trust, I transfer the legal ownership of the monies and/or

other assets to whoever is appointed as the Trustee for the benefit of the beneficiaries.

g) Saya beraku janji akan memberitahu Pemegang Amanah melalui notis bertulis secepat mungkin dalam apa jua cara, jika ada perubahan yang boleh menjejaskan struktur Amanah.

I undertake to advise the Trustee by written notice as soon as practicable in the event that of any circumstances change, which

may affect the structure of the Trust.

h) Saya faham bahawa Perancang Harta Islam adalah untuk memudahkan urusan as-Salihin Trustee Berhad untuk menjadi pemegang amanah berkenaan suatu amanah dinyatakan dan saya dengan ini bersetuju dan memberi keizinan kepada as-Salihin Trustee Berhad untuk mendapatkan butir-butir dan maklumat saya dari Perancang Harta Islam (jika berkenaan) mengenai semua aspek permohonan Amanah sehingga permohonan selesai.

I understand that the Islamic Estate Planner is merely facilitating the arrangement for as-Salihin Trustee Berhad to be the trustee

in respect of an express trust and I hereby agree and give my consent to as-Salihin Trustee Berhad to obtain my particulars and information from the Islamic Estate Planner (if applicable) regarding all aspects of the Trust Application from application to completion.

ANTI-MONEY LAUNDERING, ANTI-TERRORISM FINANCING AND PROCEEDS OF UNLAWFUL ACTIVITIES ACT 2001 DECLARATION

Ia adalah polisi AS-SALIHIN TRUSTEE BERHAD untuk mematuhi Program Pencegahan Pengubahan Wang Haram & Pencegahan Pembiayaan Keganasan (AML/CFT) di bawah Akta Pencegahan Pengubahan Wang Haram, Pencegahan Pembiayaan Keganasan dan Hasil Daripada Aktiviti Haram 2001 (AMLA 2001), kaedah dan peraturan yang diselia oleh Bank Negara Malaysia di bawah Garis Panduan AML/CFT – Designated Non-Financial Business and Professions (DNFBPs) & Other Non-Financial Sectors (Sector 5). It is the policy of AS-SALIHIN TRUSTEE BERHAD to comply with Program Anti-Money Laundering & Counter Financing of Terrorism (AML/CFT) under the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (AMLA 2001), the rules and regulations overseen by Bank Negara Malaysia under its Guidelines AML/CFT – Designated Non-Financial Business and Professions (DNFBPs) & Other Non-Financial Sectors (Sector 5).

i) tidak melibatkan dana daripada hasil jenayah sama ada secara langsung atau tidak langsung, dan ii) tidak akan melanggar mana-mana undang-undang atau peraturan dibawah AMLA 2001.

I confirm that the proposed arrangements:

i) Will not involve dealings with any funds that are either directly or indirectly the proceeds of crime, and ii) Will not breach any law or regulation to which the Settlor is subject to AMLA 2001. b) Saya faham dan bersetuju bahawa Amanah termasuk dana dan aset yang ditubuhkan dalam Amanah bukan dari dan tidak akan

digunakan untuk sebarang aktiviti yang menyalahi undang-undang seperti:

i) Menerima dan/atau mengedarkan hasil dari pengedaran dadah, rasuah atau apa-apa aktiviti jenayah lain; dan ii) Melibatkan diri dalam apa-apa bentuk pengubahan wang haram dan / atau pembiayaan keganasan.

I understand and agree that the Trust including the funds and assets set-up within the Trust are not from and will not be used for

any illegal activities such as: i) Accepting and/or distributing the proceeds from drug trafficking, corruption or any other criminal activities; and ii) Engage in any form of money laundering and/or terrorism financing. c) Saya memahami bahawa mengikut AMLA 2001, as-Salihin Trustee Berhad tidak akan membenarkan kemudahan mereka

digunakan sebagai saluran untuk pengubahan wang haram atau pembiayaan keganasan. Saya memberi jaminan kepada as-Salihin Trustee Berhad bahawa saya akan berhati-hati agar tidak membenarkan dana dan / atau mana-mana aset lain daripada hasil aktiviti haram disalurkan melalui akaun amanah saya.

I further understand that the AMLA 2001 requires as-Salihin Trustee Berhad to disallow their facilities to be used as channels for money laundering in which funds are obtained from proceeds of an unlawful activity. I assure as-Salihin Trustee Berhad that I will exercise due care not to facilitate funds and/or any other assets from proceeds of an unlawful activity to be channeled through my trust account(s)

3. Surat Ikatan Amanah Tambahan (terpakai jika ada pertambahan polisi atau Harta Amanah tertakluk kepada syarat-syarat adalah sama dengan Surat Ikatan Amanah Induk) - RM300 termasuk setem duti dan perbelanjaan Supplementary Trust Deed (Applicable for additional policy(s) or Trust Asset provided that the Terms and Conditions are same with the existing Trust Deed) – RM300 including stamp duty fee and disbursement

4. Pembatalan/Penamatan Surat Ikatan – RM300 (terpakai bagi Amanah yang boleh dibatalkan sahaja) Revocation/Termination Deed – RM300 (only applicable for revocable Trust).

5. Bagi Amanah Hayat, sekiranya Harta Amanah adalah Harta Tak Alih, maka yuran guaman dan duti setem untuk memindahmilik Harta Amanah kepada as-Salihin akan dikenakan kepada pelanggan. For Living Trust, if the Trust Asset is immovable asset, legal fee and stamp duty shall be borne by the customer when transferring the Trust Asset to as-Salihin.

• Sekiranya saham syarikat dipindah milik segera yuran dikenakan adalah RM2,000 bagi tiga (3) syarikat atau kurang di dalam satu amanah Immediate distribution of company shares fee is RM2,000 for every three (3) companies or lesser in the same trust

E) PEMBAYARAN DARIPADA SYARIKAT INSURANS/TAKAFUL KEPADA SETLOR (RM100 SETIAP PEMBAYARAN & PERBELANJAAN) PAYOUT FROM THE INSURANCE/TAKAFUL COMPANY TO SETTLOR (RM100 PER PAYMENT & DISBURSEMENT)

Hanya terpakai bagi bayaran untuk/Only applicable to payout for:

• Tuntutan perubatan dan hospital oleh Setlor dengan syarat tuntutan tersebut dilindungi oleh terma-terma dan syarat-syarat di dalam polisi takaful/insurans/ Medical and hospitalization claims of the Settlor provided it is covered by the terms and conditions of the takaful/insurance policy.

• Bonus atau pulangan pelaburan yang dinyatakan di dalam terma dan syarat-syarat Amanah/ Bonuses or investment returns which are specified in the terms and conditions of the Trust.

• Pengeluaran nilai tunai atau nilai serahan atau nilai penebusan daripada polisi takaful/insuran semasa hayat setlor untuk manfaat beliau sahaja dengan syarat tiada arahan bertulis daripada Pemegang Amanah untuk menambahkannya ke dalam harta amanah/ The withdrawal of the cash value or surrender value or redemption value of the takaful/insurance policy during the lifetime of the Settlor for his benefit only provided there are no written instructions for accumulation of the funds by the Trustee.
