Act 292


An Act to repeal the Lembaga Kemajuan Perusahaan Haiwan NegaraAct 1972 [ Act 73 ], to dissolve the Lembaga Kemajuan TernakanNegara established under the Act, to transfer all its properties to

the Government and to provide for other matters connected therewith.

[1 January 1985, P.U. (B) 590/1984 ]

BE IT ENACTED by the Seri Paduka Baginda Yang di-PertuanAgong with the advice and consent of the Dewan Negara andDewan Rakyat in Parliament assembled, and by the authority of the same, as follows:

Short title and commencement

1. This Act may be cited as the Lembaga Kemajuan TernakanNegara (Dissolution) Act 1983.

Interpretation

2. In this Act, unless the context otherwise requires

Lembaga means the Lembaga Kemajuan Ternakan Negaraestablished under the Lembaga Kemajuan Perusahaan Haiwan NegaraAct 1972 [ Act 73 ];

Minister means the Minister charged with the responsibilityfor agriculture.

Repeal and dissolution

3. The Lembaga Kemajuan Perusahaan Haiwan Negara Act 1972is repealed and the Lembaga is dissolved.

Transfer of powers, rights, etc .

4. All powers, rights, privileges, duties, liabilities and obligations

that immediately before the commencement of this Act were thoseof the Lembaga shall, on the commencement of this Act, devolveon the Government.

Transfer of property

5. (1) All lands that immediately before the commencement of this Act were vested in the Lembaga shall, on the commencementof this Act, vest in the Federal Lands Commissioner for the purposeof the Government.

(2) All property and assets other than land that immediatelybefore the commencement of this Act were vested in the Lembagaor in any person on its behalf shall, on the commencement of thisAct, vest in the Government.

Transfer of fund

6. All moneys standing in, or due to be paid to, the Lembagashall, on the commencement of this Act, be transferred to, and bevested with, the Government.

Existing contracts

7. All deeds, bonds, agreements, instruments and workingarrangements subsisting immediately before the commencementof this Act and affecting any of the property transferred undersection 5, shall be in full force and effect against or in favour of the Government and enforceable as fully and effectually as if,instead of the Lembaga or any person acting on its behalf, theGovernment had been named therein or had been a party thereto.

Continuance of civil proceedings

8. (1) Any civil proceeding or cause of action pending or existingimmediately before the commencement of this Act by or againstthe Lembaga or any person acting on its behalf may be continuedor instituted by or against the Government as it might have beenby or against the Lembaga or such person if this Act had not beenpassed.

(2) Any appeal brought or any leave to appeal applied for, onor after the commencement of this Act against a decision given

before the commencement of this Act in any legal proceedings towhich the Lembaga was a party may be brought by or against theGovernment.

Continuance of laws, etc .

9. Subject to the provisions of this Act, all written laws, orders,rules and regulations affecting or for the protection of the Lembagaand in force immediately before the commencement of this Actshall, until amended or revoked by the appropriate authority havingpower so to do, continue in force and be construed as if this Acthad not been passed:

Provided that any references therein to the Lembaga, unless thecontext otherwise requires, shall be construed as references to theGovernment and expressions importing such a reference shall beconstrued accordingly.

Prevention of difficulties or anomalies

10. (1) If any difficulty or anomaly arises in connection with theimplementation of the provisions of this Act, the Minister may byorder make such modification therein as may appear to him necessaryfor removing or preventing such difficulty or anomaly.

(2) The Minister shall not exercise the powers conferred bysubsection (1) after the expiration of three years from thecommencement of this Act.
